PRESENTATION

Fundação Abrinq has a strong focus aiming at dialogue with the government in order to protect, promote and seek realization of the rights of children and adolescents through the monitoring of legal frameworks and social indicators. It acts at the federal level through action and / or political negotiation with the three branches of government, seeking to intervene in the quality of legislative bills aimed at this age group, offering its technical positioning, in order to meet the principle of absolute priority and the doctrine of full protection, keeping them as subjects of rights.

Since 2014, Foundation has been following systematically the statistical data and legislative proposals aimed at childhood and adolescence, bringing together these studies in publications that have become benchmark for quality information and

notes for solutions and path to childhood policies across the country.

The institution also keeps the Observatory of Children and Adolescents, a platform that organizes and publishes statistical data and legislative bills under consideration by House of Representatives and the Federal Senate. The Observatory’s database compiles official information as the number of births, deaths, prenatal care, and school census and is one of the most complete in the area of policies and social indicators aimed at children and adolescents, often used as a source of information for the press.

ACTIVITIES PERFORMED IN 2020 Monitoring

In 2020, the pandemic theme was in the political debate intensely and it was necessary to focus on measures for circumventing emergency outline in public health. Out of the 792 legislative bills monitored throughout the year, 316 were focused on this issue.

The work of the Standing Committees was suspended in the Senate and the House of Representatives, the committees were not convened. Only the sessions of the Plenary of the Legislative Houses were kept but worked remotely.

Thus, several bills on the priority agenda of Fundação Abrinq were not considered, with few

exceptions, among which stands out the Proposed Amendment to the Constitution (PEC) of the Fund for the Maintenance and Development of Basic Education and Valuing Education Professionals (Fundeb) – PEC no. 15/2015, changed by Constitutional Amendment 108/2020 and PL no. 4372/2020, which regulates the new permanent Fund.

Regarding the areas out of 792 monitored bills, 357 belong to the Protection area and 119 deals specifically on the subject of COVID-19; 354 bills are Education area and about 164 on COVID-19; and 81 bills are the health area, of which 33 on COVID-19.

For the Observatory of Children and Adolescents, Fundação Abrinq requested information of Dial 100 on data showing an increase in cases of violence during the period of social distancing. Although the complaints group made considering this age group does not occupy the highest concentration of complaints of violation related to Coronavirus, it is remarkable the evolution of indicators over three months of monitoring (March-June). Overall, 18,586 reported cases of violation were reported related to COVID-19, between March 17 and June 29, 2020, of which 349 were committed against children and adolescents (3.9%).

The main age group of complaints is among younger children, 05-11 years of age, followed by reports of children 12-17 years of age.

OCCUPIED SPACES IN NETWORK AND ACTIONS Domestic Council for the Rights of Children and Adolescents (Conanda) – biennium 2019-2020 Fundação Abrinq is an alternate and served the Commission on Human Rights and Parliamentary Action, monitoring the bills under consideration by Brazilian Congress. The Conanda’s performance was present in many recommendations, among which stand out those related to the preservation of health

in host services and the use of resources of the state and city’s Funds for Children and Adolescent for purposes other than those set out in Resolution No.

137 / 2010 regarding the emergency or calamity.

Another discussion involved adolescents fulfilling socio-educational internment measure and public health issue. In this case, the debate was wider and culminated in the decision of the recreation of the Monitoring Committee of the Domestic Socio-Educational Care Plan.

Domestic Social Service Council (CNAS)

Fundação Abrinq is second alternate in the segment of social service entities. It participates actively in the Finance Committee, in which it approved the budget proposal of the Board for the financial year 2021 (Resolution No. 12/2020) and the budgetary and financial implementation reports of the Domestic Social Service Fund (FNAS), for 2nd and 3rd quarter of 2020 (Resolution No. 13/2020 and No. 19/2020, respectively).

Foundation also joined the Working Group for Consolidation of the Proposal for the Early Childhood Program Improvement in the Unified Social Service System (SUAS) established by Resolution No. 15/2020.

The major achievement of the board, however, was the recognition of families ‘access rights belonging to indigenous peoples to the benefits and services offered by the social service network (Resolution No. 20/2020).

Domestic Early Childhood Pact

Fundação Abrinq participated in the Domestic Early Childhood Pact to promote the guarantee of rights, promotion of improved infrastructure necessary to protect the interests of the child, in particular, early childhood, and the prevention of administrative impropriety by public officials who have the duty to enforce such legislation.

Foundation members lectured at the event 30 years of ECA, organized by the Domestic Council of Justice (CNJ), within the commitment of the Pact.

Collaborative Advocacy Network (RAC)

It is coordinated by the Instituto C & A Instituto Ethos and Fundación Avina, with support of Pulso Publico, the network interacts with the legislative bodies and civil society organizations to carry out advocacy focused on four topics: environmental, human rights, transparency and integrity and the new economy issues. Thus, it aims to connect collective and social interests with the Brazilian parliament.

The participation of Fundação Abrinq Foundation in 2020 contributed to the debate on the Tax Reform and the 2021 Budget Bill and their impact in the social sphere and public policy. It also worked on the adoption of the new Fundeb.

Domestic Early Childhood Network

Foundation participates in the network to promote and guarantee the rights aimed at early childhood.

The main action in 2020 was the struggle for approval of PEC Fundeb and then, for regulating the new fund with a focus on early childhood education, in daycare and preschool.

Domestic Forum on Prevention and Eradication of Child Labor (FNPETI)

Fundação Abrinq is a member organization of the Domestic Network to Combat Child Labor and has a space in the Forum for discussion of proposals, defining strategies and building consensus between government and civil society on the child labor.

In 2020, the annual campaign on June 12 was carried out online and had its theme updated to address the pandemic scenario. It was named COVID-19: Now

more than ever, to protect children and adolescents from child labor.

Foundation also worked in the drafting of Public Note on lack of data on child labor. In addition to the note, the President, the Director of Research and the advisory of the Brazilian Institute of Geography and Statistics (IBGE) was sent FNPETI letter requiring access to information on child labor in the years 2017 and 2018.

Considering the context of the cities’ elections, the Forum carried out also the campaign # VotePelaInfância to draw attention of society and young voters to the importance of choosing candidates committed to the full protection of children and adolescents, with the guarantee of all their fundamental rights, especially the right not to work.

ACTION TO MAKE THE FUNDEB PERMANENT Fundação Abrinq has a history in defense of transformation of Fundeb on a permanent mechanism for financing the basic public education, to improve the education quality. For this, it politically articulated around the theme from Bill No. 8035/2010 for the approval of the Domestic Education Plan, which resulted in Law No. 13,005 / 2014 in force since June 25, 2014.

Foundation work also provided the support of Bill No. 7029/2013, under consideration by the House of Representatives, and aims to double the resources for public day care for children, 0-3 years old in full time.

With respect to the PEC 15/2015 by Mrs. Raquel Muniz (PSC / MG), Foundation had been feeding discussions with analysis since 2016 Legislative book of Child and Adolescent. In 2017 it followed up the public hearings held in the Special Committee on the subject and participated in the public hearing in the Finance and Taxation Committee of the House
