ETEMBROFoi aprovada, através da Lei n.º 49/2011, de 7 de Setembro, a
sobretaxa extraordinária aplicável aos rendimentos auferidos no ano
de 2011 pelos sujeitos passivos de IRS.
A sobretaxa extraordinária será de 3,5% e recairá sobre a parte do
rendimento colectável resultante do englobamento que exceda, por
sujeito passivo, o valor anual da retribuição mínima mensal
garantida (€ 6.790), acrescida dos seguintes rendimentos:
- as gratificações auferidas pela prestação de trabalho, quando não
atribuídas pela entidade patronal nem por entidade que com esta
mantenha relações de grupo, domínio ou simples participação;
-o saldo positivo entre as mais-valias e menos-valias resultante da
alienação onerosa de partes sociais (incluindo a sua remição e
amortização com redução de capital) e outros valores mobiliários,
bem como o valor atribuído aos associados em resultado da partilha
que seja considerado como mais-valia, das operações relativas a
instrumentos financeiros derivados (excepto quanto aos ganhos
decorrentes de swaps cambiais, swaps de taxa de juros, swaps de
taxa de juro e divisas e de operações cambiais a prazo), das
operações relativas a warrants autónomos, quer o warrant seja
objecto de negócio de disposição anteriormente ao exercício ou quer
seja exercido, das operações relativas a certificados que atribuam ao
titular o direito de receber um valor de determinado activo
subjacente (com excepção da remuneração decorrente de
certificados que garantam ao titular o direito a receber um valor
mínimo superior ao valor de subscrição);

DMINISTRATIVAS- os rendimentos líquidos das categorias A (trabalho dependente) e
B (trabalho independente) auferidos em actividades de elevado valor
acrescentado, com carácter cientifico, artístico ou técnico, por
residentes não habituais em território português;
- os acréscimos patrimoniais não justificados de valor superior a €
100.000.
Serão dedutíveis à colecta da sobretaxa:
- 2,5 % do valor da retribuição mensal mínima garantida por cada
dependente ou afilhado civil, que não seja sujeito passivo de IRS
(€485 x 2,5%= €12,13);
- as importâncias retidas na fonte, que quando sejam superiores à
sobretaxa devida conferem o direito ao reembolso da diferença.
As entidades devedoras de rendimentos de trabalho dependente e de
pensões são obrigadas a reter 50%, respectivamente, do valor do
subsídio de Natal ou da prestação adicional correspondente ao 13.º
mês, que exceda o valor da retribuição mínima mensal garantida,
após a dedução das retenções na fonte normais e das contribuições
obrigatórias para regimes de protecção social.
A retenção na fonte é efectuada no momento em que os rendimentos
se tornam devidos ou, se anterior, no momento do seu pagamento
ou colocação à disposição dos titulares. Após procederem à retenção,
as entidades devedoras devem entregar as quantias retidas, nos
locais habituais, no prazo de 8 dias a contar do momento que foram
deduzidas, desde que antes de 23 de Dezembro.
Caso o valor correspondente ao subsídio de Natal devido ou da
prestação adicional correspondente ao 13.º mês seja pago
fraccionadamente, deverá ser retido na fonte, em cada pagamento, a
parte proporcional da sobretaxa extraordinária.
As entidades devedoras dos rendimentos do trabalho dependente e
de pensões encontram-se obrigadas a declarar os pagamentos
efectuados na Declaração Modelo 10, a entregar até ao final do mês
de Fevereiro do ano seguinte ao que respeitam os rendimentos, ou
seja, 2012.
A não entrega, total ou parcial, das quantias retidas constitui
contra-ordenação ou crime fiscal.
De salientar que a sobretaxa extraordinária aplica-se somente aos
rendimentos auferidos pelos sujeitos passivos de IRS no ano de
2011, cessando a sua vigência após a produção de todos os seus
efeitos em relação ao ano fiscal em curso.

Através da presente Informação Vinculativa a Administração Fiscal vem
esclarecer que numa situação em que o titular de um imóvel foi
declarado insolvente, tendo consequentemente o imóvel sido apreendido
a favor da massa insolvente, tal não acarreta uma mudança do sujeito
passivo. Isto porque a apreensão do imóvel apenas priva o seu titular do
exercício de poderes de administração e disposição, que passam a ser
competência do administrador de insolvência.
Assim as dívidas de IMI vencidas em data anterior à declaração de
insolvência devem ser reclamadas ao administrador de insolvência,
porém as colectas de IMI que venham a ser devidas e que se vençam
em data posterior à declaração de insolvência são da responsabilidade
do insolvente

THLaw nº 49/2011, of September 7th has approved the extraordinary
surtax applicable to income obtained by individual taxpayers during
2011.
The extraordinary surtax will be of 3.5% and will apply to
aggregated personal income, that exceeds, per taxpayer, the annual
value of the minimum wage (€ 6.790), accrued of the following
income:
- the bonuses for the work performance, when non-attributed by the
employer neither an entity with which the employer maintains group,
domain or participation relations;
- the positive balance between capital gains and capital losses
resulting from the disposal of shares (including their redemption and
amortization with reduction of share capital) and other transferable
securities, as well as the part of liquidation proceeds attributed to
the associates considered as capital gains, from operations with
derivative financial instruments (with the exception of gains on
foreign exchange swaps, interest rate swaps, interest rate and
currency swaps and forward foreign exchange contracts), from
operation with autonomous warrants, whether the warrant is subject
to negotiation of disposal prior to exercise or exercisable, from
operations concerning certificates which attribute the right to
receive a value of a certain subjacent value (with the exception of
remuneration arising from certificates that guarantee the holder the
right to receive a minimum value in excess of the subscription
value);
- the net income of categories A (employment income) and B

non-habitual residents in Portugal;
- the unjustified patrimonial increases of a value higher than €
100.000.
It will be deductable to the extraordinary surtax taxable income:
- 2,5 % of the minimum wage per each dependent or “civil godson”,
who is not a taxpayer (€485 x 2,5%= €12,13);
- The amounts withheld at source, which whenever higher than the
extraordinary surtax due determine the right to be reimbursed of the
difference.
The employers and the entities obliged to the payment of pensions
shall retain 50 %, respectively, of the value of the Christmas
allowance or of the 13th month pension, which exceeds the value of
the minimum wage, after the deduction of the standard withholding
and the mandatory welfare contributions.
The withholding at source shall be made at the moment the income
is due or, if prior, at the moment of payment or disposal to the
taxpayer. After proceeding with the withholding, the debtors shall
yield the withheld amounts, in the usual places, in the 8 days
following the withholding date, although before the 23 of December.
In case the amount correspondent to the Christmas allowance or to
the 13
thmonth pension is paid in parts, it shall be withheld, in each
payment, the proportional part of the extraordinary surtax.
The debtors of employment and pension income would be obliged to
declare the payments made in Form nº 10 (Declaração Modelo 10),
to be delivered until the end of February of the following year to
which the income respects to, meaning 2012.
The non fulfillment of the yield obligation of the withheld amounts
would be deemed as a misdemeanor or tax crime.
Finally, it should be worth mentioning that the extraordinary surtax
shall apply only to income obtained by individual taxpayers during
2011, no longer remaining in force after the production of all its
effects with regard to the year at stake.

NSOLVENCYThe present Binding Information of the General Tax Division clarifies
that in a situation in which the real estate owner was declared
insolvent, and therefore the real estate was impounded in favor of
the insolvency assets, that do not imply the change of the taxpayer.
This is due to the fact that the impound only deprives the owner of
the exercise of management and disposal powers, which pass on to
the insolvency administrator.
Accordingly, the Municipal Property Tax debts due prior to the
insolvency declaration ought to be claimed to the insolvency
administrator. However, the Municipal Property Tax taxable income
that would become due and payable in a later date is responsibility
of the insolvent.
