damage:
• No relative provisions on Treaties.
• Jurisprudential construction:
– ‘individuals may rely on EU law before national courts to seek redress, if they suffered loss or
damage as a result of a failure of a MS to meet EU obligations’.

• Facts: Applicants brought proceedings against Italian State for failure to transpose Directive 80/987 on protection of employees. Provisions invoked by applicants to support their claim for unpaid wages were not sufficiently precise and unconditional to be directly effective. Nevertheless, provisions in question were clearly intended to confer
rights on individuals, meaning State’s failure had deprived applicants of Community rights.
• Judgment: “…the full effectiveness of Community rules would be impaired and the protection of the rights which they grant would be weakened if individuals were unable to obtain redress when their rights are infringed by a breach of Community law for which a Member State can be held responsible”.

1. The result prescribed by the directive should entail the grant of rights to individuals,
2. The content of these rights must be
dentifiable on the basis of the provisions of the directive,
3. The existence of a causal link between the breach of the State's obligation and the loss and damage suffered by the injured parties must be shown.
