TECHNICAL SPECIFICATIONS FOR THE CALL FOR TENDERS TO PROCURE THE DRAFTING OF THE PRELIMINARY PROJECT FOR THE EXTENSION AND RENOVATION OF THE MUSEU D’ART CONTEMPORANI DE BARCELONA (MACBA) IN THE CONVENT DELS ÀNGELS AND, IF REQUIRED, THE DRAFTING OF THE BASIC AND EXECUTIVE PROJECTS AND THE TECHNICAL SUPPORT FOR THE CONSTRUCTION MANAGEMENT

1. OBJECT OF THE TENDER AND SCOPE OF INTERVENTION 1.1. OBJECT OF THE TENDER

The object of this tender is to select a project proposal for carrying out the extension and renovation of the Museu d’Art Contemporani de Barcelona (MACBA) in the Convent dels Àngels. The tender shall encompass the awarding of the drafting of the preliminary project.

Subsequently, through an unpublicized negotiated procedure, the winner of the tender may be awarded the services described in the Specifications as “possible subsequent awards”, as established in articles 168.d) and 185.4 of the LCSP and in the Specifications themselves. This potential awarding of additional services does not give any rights to the winner of the tender.

These “possible subsequent awards” are:

- The drafting of the basic and executive projects and other preliminary technical documents required for the tender and implementation of the corresponding works. Specifically, this will involve the following tasks:

1. To study and collect data on the building and its possible pathologies, and to improve the plans of the building’s current state, which have been enclosed with the rules of the tender.

2. To draft the basic and executive architectural projects for the renovation and extension of the building, in accordance with the functional program detailed in the Master Plan that will be provided in the second phase of the tender.

3. To collaborate, throughout the drafting process, with the person or team designated by the Museu d'Art Contemporani de Barcelona for the preparation of the museum design proposal to ensure that the it can be implemented smoothly once the works are finished or in their final phase.

4. To prepare the technical documents required to obtain previous sectoral reports (fire brigade, heritage commission, etc.).

5. To develop an action plan to obtain the environmental license for the complex.

6. To draft the pertinent health and safety study.

7. To draft the pertinent quality assurance program.

8. To process the required energy certification.

9. To prepare the building’s operation and maintenance manual.

10. Any other technical performance that may be required during the drafting of the project for approval and tender.

- Construction management and other technical services required during the execution of the works and for their commissioning. Specifically, this will involve the following tasks:

To manage the corresponding construction work and, if need be, adapt the project to preserve the entity and value of any archaeological findings that may appear during the excavation or demolition process. This shall include, where appropriate, the justification of any divergent prices that may have been processed, as well as the corresponding amendments to the project.

12. To draft the necessary documentation to validate the installations.

13. To draft the project’s final certificate.

14. To draft certificates for the fire protection systems that have been installed.

15. To procure the initial fire protection inspection report, drafted by an authorized inspection body.

16. To provide as-built documentation, including the design report, plans, and bill of materials.

17. To update the use and maintenance manual if necessary.

18. To enter the following documents into the TCQ program and the ITEC maintenance module: the actual inventory derived from the construction work and the installations according to the internal codification of Barcelona City Council; as-built and installation plans with schematic diagrams; validations and inspections required by the regulations in force; and other documents of interest for the maintenance of the building.

19. Any other technical performance that may be required during the construction process to bring the building into operation.

When these services are provided in the form of technical documents drawn up by competent professionals, they must be in compliance with current building regulations and must be approved by the relevant architecture board.

During the drafting process of the project, the Awardee will collaborate with the technical services of the Barcelona City Council to facilitate and speed up the processing of licenses and permits.

All parties interested in submitting proposals to this tender should be offered the possibility to visit the site of the future project on a date that will be determined by the Contracting Authority and published on the Contracting Platform. If possible, this visit should take place during the first twenty days of the tendering period.

The extension and renovation project will be developed in the building of the Convent dels Àngels and its surroundings, and will address the following needs:

- Renovation of an estimated 900 m2 corresponding to part of the underground levels currently occupied by the parking garage underneath Plaça dels Àngels, an area that could potentially be connected to the basement of the Meier building.

- Renovation of an estimated 1,000 m2 corresponding to the ground floor of the Convent dels Àngels.

- Extension of an estimated 1,800 m2 in the form of a new building (ground floor + 2 stories) on Plaça dels Àngels, adjacent to the north side of the dormitory of the Convent dels Àngels.

In addition, the project must meet the following needs:

- Allow passage from Plaça dels Àngels to Plaça Caramelles.

- Preserve and integrate the aedicula that serves as an exit from the underground parking garage of Plaça dels Àngels in its current location, or else relocate it.

- Demolish the marble cube on Carrer Montalegre that currently serves as an entrance to the public toilets and to the Peu de la Creu chapel; possibly relocate the public toilets.

- Possibly “cover” the current northern façade of the Peu de la Creu chapel, a work by the architects Clotet and Paricio from the 1980s, in order to unify this structure with that of the extension and perhaps even offer a link to Carrer Montalegre.

- Open an underground pathway through a part of the parking garage located underneath Plaça dels Àngels to join the extension with the Meier building. This pathway should facilitate the transport of artworks to and from the current dock of the Meier building, thereby eliminating the need for an additional loading dock in the new building. The pathway could also be conceived as a circulation axis that allows museum visitors to cross from one building to another without having to go back up to the square.

- Create a connection between the extension building and the rooftop of the Peu de la Creu chapel, and use this rooftop space as a terrace accessible to the public and as a potential open-air exhibition space.

The Convent dels Àngels is a building owned by the city council, which as per the Mayoral Decree of 26 September 2003 authorized the MACBA Consortium to use a space of 1,127 m2, located on the ground and first floors of the complex of buildings known as the Capella and the old Convent dels Àngels, for the purpose of housing the museum’s temporary exhibitions, installations and partial presentations of its collections.

At the plenary session of the Municipal Council on 18 November 2005, the MACBA consortium was awarded a concession for the private use of an area of 4,129.17 m2 (which included the 1,127 m2 of floor space granted by the Mayoral Decree of 26 September 2003) in the buildings known as the Capella and the former Convent dels Àngels, with the aim of housing temporary exhibitions, installations and partial presentations of the collections of the Museu d'Art Contemporani de Barcelona, the Centre de Documentació and the Biblioteca d’Art Contemporani.

The project will concern the property mentioned in the aspects detailed in these Technical Specifications and in accordance with the technical indications established in the Master Plan, which will be provided for informational purposes during the second phase of this tender, although its main aspects are already set out in these Specifications.

1.3. URBAN CONTEXT

After months of conversations and meetings, at the end of 2019 the City Council agreed to draw up a modification to the General Metropolitan Plan (GMP) that granted the proper zoning category to the plot where the future extension would be built and enabled the construction of this new cultural facility. This modification regulates the volume and buildable area.

This particular modification to the GMP on Plaça dels Àngels grants permission to construct a new facility to house the MACBA extension and make use of the existing underground infrastructure. This extension will have to respect and enhance the heritage of the Convent dels Àngels, especially in the parts affected by the extension, such as the apse of the chapel and the north facade of the building, where the dormitory of the Convent dels Àngels was originally located.

The modification of the GMP was initially approved on 18 February 2020 by the Ecology, Urban Planning and Mobility Committee. The documentation concerning this initial approval will be attached in addition to the documentation given to the five finalists participating in the second phase of the tender.

2. PRELIMINARY QUESTIONS

2.1. MUSEU D'ART CONTEMPORANI DE BARCELONA AND CONVENT DELS ÀNGELS: HISTORICAL BACKGROUND AND CURRENT SITUATION

MACBA was established in 1995 as part of an in-depth urban reform of the Raval neighborhood. The original building of the museum was designed by the American architect Richard Meier and provided the institution with 14,600 m2 of floor space, of which around 5,000 m2 are intended for public exhibition spaces.

In 2013, eighteen years after MACBA’s inauguration, the City Council handed over the buildings of the Convent dels Àngels to MACBA to be used for museum purposes.

These buildings provide a total of 1,800 m2 of floor space, of which 1,000 m2 will be devoted to exhibitions, as well as other uses. The lot also included the plot adjacent to the northern façade of the Convent, currently an extension of Plaça dels Àngels, where the 2,015 m2 extension is to be built. The extension project will also encompass the renovation of 900 m2 of underground space, occupying part of levels -1 and -2 of the parking garage located under Plaça dels Àngels, which could be used to create an underground connection between the extension and the museum in the future. This additional floor space will enable MACBA, twenty-five years after its establishment, to exhibit its permanent collection alongside temporary exhibitions.

The allocation of these spaces has led to careful consideration of the whole complex in order to extend and diversify the programming (of exhibitions and activities) and the uses of the museum, based on the needs of the current audience.

MACBA has set itself the goal of tackling the project and the tender for the construction of the new building in the Convent dels Àngels during the 2019-2020 period.

The intervention planned by MACBA for the Convent dels Àngels aims to expand the museum’s exhibition space so that its temporary exhibitions can be displayed alongside its permanent collection, taking advantage of the new use, layout and size specifications for the creation of a public cultural facility in the Convent dels Àngels, as laid out in the Modification to the GMP. This plan, which provides for the future work in the convent, specifies an extendable floor area of 2,000 m2 and explicitly states that the erected building must serve a cultural purpose.

The MACBA extension will be located on the part of the convent across from the façade of the old dormitory, on its north side, in what was once the nuns’ garden.

The Convent dels Àngels comprises the group of buildings and courtyards that once formed the Augustinian nunnery of Nostra Senyora dels Àngels i Peu de la Creu. The extension also includes the reform of the ground floor of the Convent dels Àngels, formed by the Capella dels Àngels as well as the old dormitory, which will be connected to the new building. In addition, it involves the renovation of the underground parking garage to fit out part of it as a space for the storage and circulation of works of art. The plan also foresees an underground pathway between the existing parking garage and the basement of the Meier building, which will facilitate the transport of works of art between the two buildings without the need to go up to the ground level.

The complex is currently made up of three blocks of buildings: the first, on Carrer dels Àngels 7, includes the old novitiate building and an adjoining house, as well as two houses at the southern end of the street; the second is the convent’s dormitory, with a façade facing the street and Plaça dels Àngels and a floor plan perpendicular

to the square;the third is formed by the church and the Capella del Sagrament, whose façades also overlook Plaça dels Àngels.

As one of Barcelona’s few vestiges of Renaissance architecture, the complex bears witness to the very scarce presence of this artistic trend in our city, where the antecedent Gothic tradition lasted longer. The dormitory and church of the convent – the most remarkable parts of this fragment of the urban fabric from the sixteenth century – are poor quality constructions erected by Bartomeu Roig during the second half of the 1500s.

The building is listed at the maximum protection level in the catalogue of protected buildings of the city, since it is considered a cultural heritage site of national interest.

In this sense, it seems reasonable to expect that the future building will honor the spirit and structure of the northern façade of the building that housed the convent dormitory, as well as the church apse.

Bearing in mind these considerations, the museum is announcing a public call for tenders to draft the design and perform the construction work. Its specifications include both the building use plan and the formal intentions described, in the belief that a building dedicated to exhibition purposes can provide an adequate solution, enhancing the façade and the external structural elements of both the chapel and the convent.

The future extension will have a net floor area of about 650 m2 and will be developed into a ground floor and two stories, resulting in a constructed area of about 2,015 m2, which, added to the 1,000 m2 ground floor of the convent and chapel, represent a total exhibition area of 3,015 m2. As far as circulation is concerned, the future extension will provide access from Carrer Elisabets to the intended exhibition space, thus creating a direct route to La Rambla de Barcelona. It also envisages an entryway facing Plaça dels Àngels, across from the main entrance to the Meier building, which will stress the relationship between the extension and the current museum while allowing for easy circulation between both buildings.

2.2. AREAS AND USES

3. PURPOSE OF THE PROGRAM

The purpose of this tender is to select a proposal for the extension and renovation of the Museu d’Art Contemporani in the Convent dels Àngels. The main objectives proposed for this special program of extension and renovation are:

- To provide MACBA with a space that is both sufficient in size and well adapted to the new needs of art, so that the museum can fully develop its exhibition and educational mission and satisfactorily fulfil its public function.

- To preserve and enhance the quality of its architecture as a hallmark of the institution, and adapt it to its evolving urban surroundings.

- To improve the accessibility of the museum for all visitors and make its facilities environmentally more sustainable.

- To provide the most innovative spaces and technical means to ensure that the museum fulfils its commitment to the study and conservation of its artistic heritage.

- To connect the different buildings of the museum:

· Meier building

· Study Centre (CED) building

· Convent dels Àngels

· Extension

4. SPECIFIC TECHNICAL REQUIREMENTS 4.1. GENERAL GUIDELINES

The aims of this renovation and extension project are to:

- Provide the museum with more space and adequate facilities to fully develop the potential of its collections and activities.

- Increase the visibility of and give a prominent role to the museum and its historical and architectural identity.

- Improve accessibility and comfort for visitors and thus contribute to enriching the extraordinary cultural and artistic landscape of the city.

With these goals in mind, the project must:

- Integrate the new architecture with the two existing buildings, a testament to two different types of art exhibition.

- Provide the best urban planning solution, taking advantage of the privileged location of the museum in and around Plaça dels Àngels.

- Improve its accessibility and communication in relation to the city’s tourist flows and, specifically, in relation to the Meier building.

- Expand the exhibition area of the collection to a total of 3,015 m2.

Furthermore, the project must adhere to the following general guidelines:

- It should respect the architectural character of existing buildings.

- It should optimize the building’s uses and circulation patterns.

- It should guarantee the building’s stability and structural safety.

- It should connect tourist flows and adapt to its urban environment.

- It should be as accessible to all as possible.

- It should reflect the museum’s mission of conservation and exhibition of cultural and artistic property.

- It should adjust the architecture to its public mission and the current regulations.

- It should apply sustainability and energy efficiency criteria.

4.2. MASTER PLAN

The Master Plan, which shall serve as a guide for drafting the architectural proposal for the reform and expansion of the Convent dels Àngels, envisages the renovation of the ground floor of the Convent dels Àngels building in order to adapt it to the new planned uses; the renovation of the 900 m2 parking garage located under Plaça dels Àngels, which will be fitted out as a space for the circulation and storage of works of art; and the construction of a new building with an area of 2,015 m2.

The area gained from the expansion of the Convent dels Àngels must adhere to the following requirement plan:

. Thanks to the acquisitions made by the MACBA Foundation over the past twenty-five years, the museum's collection has grown spectacularly. The museum therefore requires a significantly larger space for its permanent collection. In addition to this quantitative aspect, there is a need to develop the chronological concept of the collection, integrating later and especially relevant expressions of the contemporary art scene. The requirement plan considers the possibility of devoting all the exhibition space of the new building to this collection, so that it would expand from the current 1,700 m2 to 3,015 m2, a 75%

increase of the current surface area dedicated to this use.

- New storage spaces in the basement, making use of a part of the existing parking garage under Plaça dels Àngels, with the option of a possible future connection with the basement of the Meier building. This will necessitate the installation of a freight elevator in the extension in order to circulate the works of art.

The Master Plan will be handed over to the selected bidders who move on to the second phase, i.e. the submission of proposals.

4.3. FUNCTIONAL REQUIREMENTS

The extension of the MACBA is justified, among other reasons, by the need to expand the exhibition space in order to properly display the museum’s permanent collection, which has grown steadily over the years thanks to the acquisition of new pieces by the MACBA Foundation and other contributions. The museum thus needs a space dedicated exclusively to this collection, allowing the rest of the space to be used for temporary exhibitions.

As mentioned above, the project envisages: first, the construction of a new building above Plaça dels Àngels, mainly for exhibition purposes; second, the renovation of the ground floor of the Convent dels Àngels, to join it to the new building in an integrated exhibition complex; finally, the renovation of part of the underground levels currently occupied by the parking garage underneath Plaça dels Àngels, an area that could potentially be connected to the basement of the Meier building and be used for circulation and storage purposes.

The project also includes the demolition of the marble cube on Carrer Montalegre, which currently serves as access to the public toilets located in the lower part of the northern façade of the Capella dels Àngels.

The possibility of covering the northern façade of the Capella dels Àngels is also being considered, in order to give continuity to the complex and achieve a compositional unit with the façade of the extension.

Underground levels

The underground levels, which will occupy part of the parking garage under Plaça del Àngels, will be used for the circulation and storage of works of art. They will be equipped with a freight elevator that connects it to the upper levels all the way, up to the rooftop. The possibility of connecting this levels to the basement of the Meier building is also being studied.

As mentioned above, there is the possibility of opening this underground pathway to visitors, who would thus not have to cross Plaça dels Àngels to go from one building of the museum to another.

This level should provide access for small and medium-format artworks, which can be transported with a medium-size vehicle capable of accessing the parking lot.

The total floor area to be occupied in the underground levels is 900 m2: 630 m2 on level -1 and 270 m2 on level -2.

Ground level

The two access points to the extension will be on the ground level: one on Carrer Montalegre, which will lead to the Renaissance chapel, and one on the other side, on Plaça dels Àngels, which will connect the extension with the Meier building. The lobby on Carrer Montalegre will include a reception, a ticket sales desk and a shop, while on the other side of the square there will be an entryway with turnstiles.

The lobby should have an area of about 105 m2, including the shop.

The space currently known as the Forum will be converted into a multi-purpose hall, which should be able to accommodate different educational or exhibition activities.

This space should have an area of 165 m2.

The aedicula that serves as an exit to the underground parking garage must be integrated into the new building or relocated elsewhere.

This level must also accommodate a control center that will centralize signals for the detection and extinction of fire, burglary, etc. This space will have an area of 10 m2. The level must also be equipped with a vertical access core that will allow the user to access all levels. This vertical access core will be shared by visitors and museum staff.

Each of the levels will also have a restroom core.

The rest of the floor space will be dedicated to the exhibition of works of art and will be divided between the different areas:

- The chapel 415.50 m2

- Exhibition room of the Convent 358.70 m2

- Extension 735.00 m2

First and second levels

The first and second levels will be dedicated to exhibition space and include the necessary hygienic and storage chambers for its proper functioning.

These levels will be recessed from the northern façade of the Convent dels Angels and the apse of the chapel, so the intervention is as minor as possible in this 14th century building and guarantees its appropriate architectural enhancement.

The exhibition area on each level will be 585 m2.

Rooftop

Preferably, the rooftop of the extension will be landscaped and accessible exclusively for maintenance purposes.

Vertical access core

A vertical access core will be designed to facilitate the movement of visitors and museum staff to the different levels, from the ground level to the rooftop. This core will have the stairs and elevators prescribed by law. The use of the existing cores in the Convent dels Àngels to service the expansion is another possibility to be considered.

A freight elevator will also be installed to transport works of art, connecting the basement to the rooftop for the exclusive use of museum staff.

Provided that the functional requirements detailed in these Specifications are respected, the bidders may propose the distribution, volumetric arrangements and materials they consider most suitable to their proposal.

The proposal for the spatial distribution should take the two following functional distinctions into account:

- The relationship of the spaces with the cultural assets: depending on whether they house collections or not, since the presence of artworks dictates specific environmental conditions and safety requirements.

- The relationship of the spaces with the users: depending on whether they are intended for public or internal activities, since the presence of the public also

entails certain requirements in terms of climatic comfort and demands more security measures.

Combined, these two factors define four distinct types of areas:

- Space without artworks open to visitors - Space with artworks open to visitors

- Space without artworks for employees only - Space with artworks for employees only

Each of these areas will have a series of services and be adapted to specific conditions, determined by the type of user and the presence or absence of cultural assets. This classification by areas does not imply that the spaces it distinguishes must be physically grouped in the same area of the building, but rather that they will have analogous requirements. Tenderers shall consider these indications, but may propose alternative adjustments, provided that they are duly justified.

The final net floor space of the building will depend on the specific characteristics of the project. It could be less than requested, if in the final architectural solution other issues prevail, such as the enhancement of the museum, its functionality, etc.

5. DEVELOPMENT OF THE PROJECT

Once the tender governed by these specifications has concluded, the museum will award the service of drafting the Preliminary Project to the tenderer ranked in first place.

The drafting deadline for the Preliminary Project will be of 1 month from the formalization of the Contract.

As indicated in Section 1, "possible subsequent awards" may be granted to the winner of the tender through an unpublicized negotiated procedure.

The drafting deadlines for these “possible subsequent awards”, once their corresponding contracts are formalized, are as follows:

- Basic Project: 4 months from the delivery of the Preliminary Project.

- Executive Project: 3 months from the delivery of the Basic Project.

Before the start of each phase of the project and after its delivery, the Coordination Team designated by the museum will issue a technical report, the requirements of which must be taken into account in the following phase. In the case of the Executive Project, said report must be favorable for it to be accepted. The deadlines for all these procedures will not exceed 5 days. However, during the Preliminary Project phase, a minimum of two meetings per month will be required between the architectural team and the museum.

In the event that this award is not achieved with the team classified in first place, or if it is not possible to verify whether the team meets the mandatory solvency requirements, the museum will request the documentation from the second-place team, in accordance with the provisions of Article 150 of the Spanish Law 9/2017 of 8 November on Public Sector Contracts (LCSP).

The execution and expenses related to the possible work of drawing up plans to complement the graphic materials delivered shall be borne by the tenderers. The Awardee of this Contract shall perform the relevant verifications of the graphic materials delivered. The Executive Project will contain all the documentation necessary for tendering the work.
