O Mercado Norte-americano de Pescados e Frutos do Mar
Com um produto interno bruto de US$ 12 trilhões e uma população de mais de 295 milhões de habitantes, os Estados Unidos se configuram como o maior mercado consumidor do mundo, em 2005, suas importações atingiram a marca de US$ 1,9 trilhões, ou três vezes o PIB brasileiro.
Segundo o National Fisheries Institute (NFI), os Estados Unidos são o maior consumidor mundial de pescados e frutos do mar, a frente da Indonésia, China, Japão e Russía, respectivamente. No ano passado, as importações norte-americanas do capítulo 03 – peixes e crustáceos, moluscos e outros invertebrados aquáticos - somaram US$ 9.2 bilhões. As perspectivas para 2006 são de crescimento, uma vez que as importações deste setor apresentaram um aumento de 6.7% em relação ao ano de 2004.
O Brasil detêm apenas 1.52% deste mercado, posicionando-se como o décimo segundo país que mais que mais exporta estes produtos para os EUA, atrás de fornecedores importantes como Canadá, com 19%; China, com 11% e Chile, com 7% do mercado importador. A despeito do crescimento geral das importações do setor, as exportações brasileiras apresentaram um declínio de 16% em relação a 2004, o que pode ser explicado pelo aumento substancial das exportações de outros países, como a Rússia, cujas exportações cresceram 44%; e pela imposição da medida de antidumping para os exportadores brasileiros de camarão, o principal produto da pauta de importação norte-americana. Cabe ressaltar, que embora a participação brasileira do mercado americano seja pequena, o potencial importador a ser explorado é de cerca de US$ 8.8 bilhões.
As importações norte-americanas estão concentradas em apenas seis categorias, que juntos representam cerca de 70% das importações totais: camarões, com 30%; filés de peixe frescos, com 21%; carangueijos, com 6.7%; filés de peixe congelados, com 4.4%; lagostas, com 3.7% e salmão, com 3.6% do total. De acordo com o National Oceanic & Athmospheric Administration (NOAA), os distritos que mais importam pescados e frutos do mar são Anchorage, AK; Los Angeles, CA; Portland, OR; San Diego, CA; San Francisco, CA e Seattle, WA.
Cinco categorias são responsáveis por 87% das exportações brasileiras para os Estados Unidos: lagostas, com 53%; filés de peixes frecos, com 9.3%; filés de peixe congelados, com 9.1%; camarões, com 8.6% e atum, com 7.6% do total. Os onze produtos mais importados do Brasil, de acordo com os nomes comerciais utilizados nos EUA, foram: Lobster Rock Frozen, Tuna Yellowfin Fresh, Snapper (Lutjanidae Spp.) Frozen, Snapper Fresh, Shrimp Shell-on Frozen > 70, Tilapia Fillet Fresh, Marine Fish Nspf Fresh, Marine Fish Frozen, Shrimp Shell-on Frozen 61/70, Fish Fillet Blocks Frozen > 4.5 Kg e Tuna Bigeye Fresh.
Os maiores estados exportadores brasileiros são Ceará, com US$ 45 milhões; Pernambuco, com US$ 25 milhões; Rio Grande do Norte, com US$ 16 milhões; Pará, com US$ 16 milhões; Espírito Santo, com US$ 5.8 milhões e São Paulo, com US$ 5.2 milhões exportados para os Estados Unidos em 2005.
6 Há 2.456 distribuidores de pescados e frutos de mar nos Estados Unidos, cujas vendas ultrapassaram US$ 11 bilhões em 2002. estão distribuidos, em sua maioria, nos estados da Flórida, com 293; New York, com 291; Califórnia, com 269; Maine, com 181 e Massachusetts, com 163 estabelecimentos.
De acordo com o NFI, os maiores varejistas do setor são Gorton’s, com 12.10% do mercado; Aurora Foods, com 9.10%; Aqua Star, com 3.5%; Rich-SeaPak, com 2.9%; Singleton Seafood Corp., com 2.3%; Contessa Seafood Products, com 1.9%; Tai Foong USA e Colorado Boxed Beef, com 1.4% cada e Sail, com 1.3%.
As principais redes de restaurantes de pescados e frutos do mar são: Red Lobster (Darden Rest. Group), Long John Silvers (Yum Brands.), Landry’s/Joe’s Crab Shack/Chart House, Captain D’s Seafood, McCormick & Schmick’s, Legal Seafood, Bubba Gump Shrimp Co., Bonefish Grill, McGrath’s Fish House, Rockfish Seafood Grill e Shells Restaurant.

Exigências para Exportação
Desde a entrada em vigor da lei do Bioterrorismo, para que um produto na área de alimentos seja exportado para os Estados Unidos são necessários uma série de registros junto ao FDA que visam a proteção da cadeia alimentar contra possíveis atos terroristas, conforme abaixo:
• Registro do Estabelecimento junto ao FDA: exigido para produtores, processadores, embaladores ou armazenadores de alimento que se destinam ao consumo ou trânsito por território norte-americanos.
• Designação de um agente norte-americano que esteja disponível 24 horas por dia e sete dias por semana, de forma que possa atender qualquer tipo de emergência.
• Prior Notice: aviso prévio que deve ser enviado de 5 dias ao, no máximo, 8 horas de antecedência da chegada do produto em qualquer porto americano.
• FCE (Food Canning Establishement): requerido para alimentos enlatados ou que contenham certo nível de acidez.
• SDI (Submission Identifier Number): documentação que deve ser preenchida para cada processo usado na produção de alimentos e bebidas que demandam o registro FCE.
Os registros para exportação de alimentos exigidos pela Lei do Bioterrorismo podem ser feitos diretamente pelo site da FDA, sem nenhum custo. Há, inclusive, tutoriais bem detalhados que auxiliam o preenchimento dos formulários. O registro do estabelecimento deverá ser feito no Food Facility
Registration Module (FFRM), você receberá a confirmação do seu registro e o número do mesmo
imediatamente após completar todos os campo obrigatórios do formulário.

Tarifas de Importação
O Harmonized Tariff Schedule (HTS), sistema de classificação fiscal dos Estados Unidos, possui 120 classificações no capítulo 03 - Peixes e Crustáceos, Moluscos e Outros Invertebrados Aquáticos. Em termos de tarifas de importação, o setor é bem liberalizado, uma vez que 82.5% das aliquotas são Duty Free e a tarifa aplicada mais alta é de 15%.
Além disto, os exportadores brasileiros de pescados e frutos do mar devem estar atentos aos benefícios concedidos através do Sistema Geral de Preferências (SGP). O SGP é um ato unilateral de tratamento preferencial, por meio do qual os países desenvolvidos concedem a redução total ou parcial das tarifas de importação sobre produtos pré-estabelecidos originários de países em desenvolvimento. O SGP dos Estados Unidos, em especial, concede a isenção tarifária para cerca de 3.359 produtos provenientes dos Brasil.
O programa norte-americano é um dos mais simples do gênero, pois não exige extensas documentações. Para obter a isenção das tarifas de importação no SGP norte-americano, o produto importado deve ser originário de um país beneficiário; preencher os requisitos de Regra de Origem; constar na lista de produtos elegíveis para o SGP e que o importador solicite a isenção da tarifa de importação à alfândega norte-americana através da simples colocação do Special Program Indicator, a letra A, na frente da classificação HTSUS do produto nos documentos de liberação alfandegária. No caso do setor de pesca, há 16 classificações cobertas pelo programa.
A tabela abaixo informa o código HTS, a descrição do produto e a tarifa de importação incidente no mesmo. A última coluna, denominada SGP, informa se o produto é elegível a requisitar a isenção da tarifa de importação em decorrência do programa.

Exigências para Comercialização
The United States Food and Drug Administration (FDA) é o órgão responsável pela regulação da importação pescados e frutos do mar frescos, enlatados, congelados, salgados ou defumados. Estes produtos devem estar de acordo com o Federal Food, Drug, and Cosmetic Act, cujo cumprimento é supervisionado através de inspeções periódicas das fábricas e dos produtos, análise de exemplos, atividades educacionais e processos jurídicos.
Os padrões sanitários para a produção dos alimentos são determinados pelo FDA através do Current Good Manufacturing Practice in Manufacturing, Packing, or Holding Human Food – Parte 110, do Título 21, do Code of Federal Regulation – que estabelece as condições dos equipamentos, de controle sanitário e do processo de fabricação do produto, as quais, se seguidas corretamente, poderão assegurar que o mesmo é adequado para o consumo humano. Apesar da existência destes padrões, o FDA reconhece a existência de falhas naturais ou inevitáveis na fabricação de alimentos e por isto estabelece, através do The Food Defect Action Levels, os níveis máximos destes “defeitos”.
No que concerne, especificamente, a indústria de pescados e frutos do mar, deve-se estar atento as exigências da Parte 123 - Fish & Fishery Products, do Code of Federal Regulations – Title 21. dentre outros pontos, esta legislação estabelece os procedimentos estabelecidos de Hazard Analysis Critical Control Point (HACCP), que visam assegurar que os produtos sejam adequadamente processados, embalados, estocados e distribuídos através de controles preventivos que garantam a adequação do consumo dos produtos.
É importante ressaltar que trata-se de produtos altamente perecíveis e por isso requerem muito cuidado para evitar a sua decomposição. Duas causas comuns de detenção de cargas no porto de entrada são a presença de "feedy, belly-blown" – peixes com estômagos cheios de comida quando pescados – pois deterioram rapidamente, e produtos contaminados com resíduos de pesticidas, mercúrio e outros metais pesados.
O FDA proíbe o uso de colorantes artificiais usados para disfarçar os danos ou melhorar a aparência de um produto de qualidade inferior. De fato, o uso de aditivos em qualquer tipo de alimento exige a aprovação prévia do FDA e a comprovação, por parte do fabricante, de que aquele aditivo é seguro para consumo. Todavia, há dois grupos de aditivos para os quais não se requer a pré-aprovação: todas as substâncias determinadas seguras para o consumo antes da emenda de 1958 que instituiu a necessidade da pré-aprovação, como nitrito de sódio; e as substâncias amplamente reconhecidas como seguras pelos especialistas, as chamadas GRAS (Generally Recognized As Safe), com base no seu amplo histórico de uso em alimentos antes de 1958, ou com base em evidências científicas publicadas. São exemplos de substâncias GRAS: açúcar, sal, pimentas, vitaminas e glutamato de sódio.

Rotulagem
A identificação do peixe na embalagem deve ser feita de acordo com o uso comum nos Estados Unidos. Não é permitido substituir o nome norte-americano conhecido pelo nome do país de origem; caso se trate de um produto não comercializado nos EUA, seu nome deve refletir a classificação biológica do peixe e não deve ser confundido com o nome conhecido de outra espécie.
Para evitar a identificação incorreta do peixe no rótulo da embalagem, recomenda-se a consulta ao Seafood List, uma compilação dos nomes comerciais de peixes nos EUA e assegura a correta rotulagem de acordo com as regulações do FDA: www.cfsan.fda.gov/~frf/seaintro.html

Estão isentos da necessidade de rótulo, com informações nutricionais na embalagem, peixes e frutos do mar, sejam eles congelados, frescos ou enlatados, vendidos para operações de serviços de alimentos e aqueles preparados e vendidos em delicatessens. Se o exportador preferir incluir tais informações, o rótulo deverá seguir rigorosamente as exigências do FDA. Peixes e frutos do mar a serem comercializados no varejo deverão obrigatóriamente estar rotulados de acordo com as especificações do FDA.
Os rótulos devem estar em conformidade com os requisitos estabelecidos pelo Fair Packaging and Labeling Act, pelo Nutrition Labeling and Education Act e pelo Food Labeling – parte 101, do do Título 21, do Code of Federal Regulation. Segundo a legislação, não é necessário nenhum tipo de pré-aprovação do rótulo para que o alimento seja importado ou distribuido nos EUA.
Cabe ressaltar que as legislações a respeito deste tema são frequentemente alteradas e que é da responsabilidade do produtor estar em conformidade com as mesmas. Segue uma breve explicação das principais exigências em relação a embalagem e rotulagem de produtos alimentícios, a qual, de forma alguma, dispensa uma leitura atenta das legislações supracitadas.
O nome do produto (statement of identity) e o seu peso (net quantity statement) devem estar descritos no Principal Painel de Exposição (PPE) do produto, ou seja, na porção da embalagem mais provável de ser vista pelo consumidor no momento da compra.
O nome comum do alimento deve ser usado como nome do produto, o qual deverá estar em negrito e escrito em um tamanho razoável em relação às demais informações impressas, na medida em que este deve ser uma das características mais importantes do PPE. Quanto a natureza da comida for óbvia, um nome fantasia poderá ser usado.
24 Se o produto for vendido em uma forma diferente da usual, o rótulo também deve descrever a forma do alimento empacotado, como, por exemplo, fatiado, não fatiado e metades. Se o alimento for parecido com um produto tradicional, ele deve ser rotulado como imitação se conter uma quantidade menor de proteínas ou qualquer vitamina ou mineral essencial, em relação ao tradicional.
O peso do produto deve ser colocado na parte inferior do PPE, em uma área correspondente à correspondente a 30% do painel principal. Segundo a legislação, o peso deve ser expresso tanto no sistema métrico (gramas, quilogramas, mililitros e litros), quanto no U.S. Customary System (ounces, pounds, fluid ounces). O sistema métrico pode ser colocado antes, depois, acima ou abaixo do sistema americano.
È importantante calcular a área do PPE para determinar o tamanho mínimo aceitável das informações sobre peso e quantidade do alimento.
O Painel de Informação é aquele que está imediatamente ao lado direito do PPE e contém a lista de ingredientes, o quadro das informações nutricionais e os dados do produtor, empacotador ou distribuidor do produto. Desde 2004 o United States Department of Agriculture (USDA) exige que os exportadores de pescados e frutos do mar que sua mercadoria contenha o “country of origin labeling” (COOL). É proibida a colocação de qualquer material não requerido no painel de informação, como o código de barras UPC.
Além do nome, os dados do produtor, empacotador ou distribuidor devem conter as seguintes informações: a) se o produtor e o distribuidor não forem a mesma empresa, deve-se inserir a frase "manufactured for" or "distributed by", b) Endereço, cidade, estado e ZIP Code. No caso de alimentos produzidos fora dos Estados Unidos, deve-se informar o Mailing Code
25 comum do ingrediente, como açúcar ao invés de “sacarose”, a não ser que haja uma regulação específica que determine o contrário.
Conforme determina o 21 CRF.9, as informações nutricionais devem ser disponibizadas em todos os produtos, com exceção dos seguintes casos: quando produzidos por pequenas empresas; nos alimentos servidos em restaurantes ou entregados em caso prontos para consumo; produtos de padaria que são vendidos diretos ao consumidor no local de preparação dos mesmos; alimentos que não contêm nutrição significativa como café e pimenta; “infant formula” ou comidas para criança que já necessitam de uma rotulagem especial; suplementos dietéticos e alimentos medicinais. O quadro de informações nutricionais deve ser colocado no painel de informações. O tamanho adequado da letra é sugerido na ilustração abaixo:
