Article 11 protects public/private assemblies/ open air/in-door stationary or processions/short or long-lasting
III. Freedom of Assembly (1/2)
Article 11 (1) ECHR protects only peaceful forms of communication.
Positive obligation to protect demonstrations.
III. Freedom of Assembly (2/2)
A prohibition of an assembly, disciplinary/ penal
sanctions related to participation in a demonstration
interferences.
Interferences
National security.
Public safety.
Prevention of disorder/crime.
Protection of health or morals.
Protection of the rights and freedoms of others.
• An assembly ban only permissible in exceptional cases.
Restrictions
1. Protection.
Protects the formation of collective entities by individuals for lawful reasons.
Political parties protected by Article 11 (1) ECHR. It covers also unconstitutional parties.
It covers also the negative aspect of the freedom of association.
IV. Freedom of association
The dissolution of an association.
The prohibition of some of its activities.
The imposition of sanctions, on account of membership or non- membership.
2. Interferences
Only in Article 11 (2) ECHR (if necessary – provided by law).
If a party pursues unconstitutional objectives the state enjoys a wide margin of appreciation.
3.Restrictions
Trade unions enjoy freedom of association in any case.
1. Scope of protection.
Trade unions are protected “for the protection of their interests”.
a)Individual freedom to form and join trade unions.
• Also included employers’ federations, associations of medical.
practitioners.
• Also includes the negative freedom of association.
• Article 11 (1) applicable in the case of a boycott initiated by trade unions, in order to force the employee into an

According to ECrtHR trade unions have the right to operate in public
Trade unions should enjoy the same level of protection as individuals
A total exclusion of the right to strike incompatible with Art. 11 ECHR.

Interferences only if provided by law and are necessary in a democratic society.
