65. DISCLOSURES OF INTEREST

(i) Councillor Sher Khan disclosed a personal interest in the item relating to objections to proposed disabled persons parking - St Stephens Road, Bradford (Minute 69), for the sake of transparency, as he had a previous discussion with the applicant in his capacity as a ward Member. As the interest was not prejudicial in accordance with the Members’ Code of Conduct (Part 4A of the Constitution) he remained to participate in the meeting when the item was considered.

(ii) Councillor Servant disclosed a prejudicial interest in the item relating to further objections and representations to the proposed Traffic Regulation Order on Emm Lane and Ashwell Road, Heaton (Minute 70) as he was directly affected with the proposal. As the interest was prejudicial in accordance with the Members’ Code of Conduct (Part 4A of the Constitution) he therefore withdrew from the meeting during the consideration of this item.

67. INSPECTION OF REPORTS AND BACKGROUND PAPERS

There were no appeals submitted by the public to review decisions to restrict documents.

69. OBJECTIONS TO PROPOSED DISABLED PERSONS PARKING -

SELBORNE VILLAS, CLAYTON AND ST STEPHENS ROAD, BRADFORD Previous reference: Minute 40 (2008-2009)

The report of the Strategic Director of Regeneration (Document “AK”) considered objections received to the recently advertised Traffic Regulation Order to introduce disabled persons parking places on Selborne Villas, Clayton and St Stephens Road, Bradford.

SELBORNE VILLAS, CLAYTON –

A representative on behalf of the applicant for the proposal attended the meeting and stated that the request for the parking space had began in 2007 and that there had been long delays in implementing the provision due to objections.

In response to a Member question, the Principal Engineer reported that a disabled person with a blue badge and in receipt of Higher Rate Disability Living Allowance qualified for disabled parking provision under the Council policy.

ST STEPHENS ROAD –

A neighbour who objected to the proposal attended the meeting and mentioned that the disabled person seemed fine when walking; that his daughter was using the space in front of their residence to park her car as opposed to the disabled person.

In response to the objector’s concerns, it was reported that under Council Policy, it was not a requirement for the disabled person to own a vehicle or be able to drive. A parking provision was a concession to help disabled people who drive or travel as passengers to get close as possible to their destination.

Resolved –

(1) That the objections to the Traffic Regulation Order to provide disabled persons parking places on Selborne Villas, Clayton and St Stephens Road, Bradford be overruled.

(2) That the City of Bradford Metropolitan District Council (Bradford West) (Waiting, Loading and Parking) (Consolidation) (Amendment) Order, St Stephens Road and Selborne Villas, Bradford be sealed and implemented as advertised.

(3) That the objectors be informed accordingly.

70. FURTHER OBJECTIONS AND REPRESENTATIONS TO THE PROPOSED TRAFFIC REGULATION ORDER ON EMM LANE AND ASHWELL ROAD, HEATON

Previous reference: Minute 53 (2009-2010)

The report of the Strategic Director of Regeneration (Document “AL”) considered the outcome of a special neighbourhood forum meeting with the residents of Heaton Village regarding proposals to introduce waiting restrictions on Emm Lane and Ashwell Road, Heaton.

The Principal Engineer stated that further to previous issues raised by objectors and the special neighbourhood forum it was nonetheless believed that the original proposal, as highlighted in Appendix 3, was the most appropriate solution to the ongoing problem.

A resident affected by the proposal attended the meeting and highlighted that he agreed in principle to the proposal, but options were still available to modify certain aspects.

The proposed options were not in the best interest of residents due to the safety implications of residents not being taken into consideration.

A more reasonable solution would be to provide residents only parking outside residents properties on Emm Lane.

It would be an unsafe option for residents to park next to the grass verge as it would entail an arduous task for car users to get in/out of vehicles due to the sloped grass verge.

Residents would have to cross a busy main road to get to their properties. People of all ages would be at risk due to busy traffic flow.

Residents had the right to park directly outside their homes.

In response to comments, the Principal Engineer stated that:

The proposal would restrict parking from students using the Bradford University School of Management and on Ashwell Road near to its junction neighbouring Emm Lane. This proposal would help to improve road safety.

A residence parking provision could only be accommodated if the majority of residents did not have off-street parking.

Many residents had the option of parking in their driveways.

The special consideration to the proposed sight lines was taken into consideration to maintain good visible lines at the busiest times and improve access for all users.

The introduction of an 8am to 6pm Monday to Friday restriction would allow the dropping off and picking up of passengers during the working day.

Members of the public were generally mistaken to believe that drivers had a legal right to park on the public highway and that many householders incorrectly believed that the length of highway outside their home was for their personal use. The basic rule was that the only right the public had with respect to the highway was to travel along it and that parking was tolerated.

The Chair sympathised with the concerns outlined by the resident but expressed the practicality the proposal would bring in alleviating the inconsiderate parking on Emm Lane by users of the University and assist in relieving further road injury collisions.

Resolved –

(1) That the Traffic Regulation Order for Emm Lane and Ashwell Road be modified as shown on drawing R/S/BW/100618/TRO-2A attached as Appendix 3, to Document “AL”.

(2) That residents affected by the modified Order be consulted and any new valid objections be reported to the Bradford West Area Committee or in the event that there are no new valid objections the Order be sealed and implemented.

(3) That the objectors be informed accordingly.
