2.8. Busca de patentes relacionadas à P americana e S malaccense

38 No Brasil, a legislação impede a proteção de produtos que foram isolados da natureza, considerando que o todo ou parte de seres vivos e materiais biológicos obtidos na natureza, assim como os seus materiais isolados não são invenção. Apesar disso, se for conferido o uso prático desses produtos, utilizando moléculas isoladas ou frações de extratos de planta, constituindo uma composição juntamente com outros componentes, esses passam a ser patenteáveis (BRASIL, 1996; JANNUZZI; VASCONCELLOS; SOUZA, 2008).

Ao realizar a busca de patentes que utilizaram folhas de P. americana e S. malaccense, objetos desse trabalho, em bancos de dados nacionais e internacionais, como o Instituto Nacional da Propriedade Industrial (INPI), ESPACENET, LATIPAT, PATENTSCOPE® e USPTO, foram encontradas 6 patentes registradas de P. americana, porém apenas duas tinham enfoque em aplicações comerciais e apenas uma patente de S. malaccense nesse contexto (Tabela 3).

Diante da busca de patentes realizada, não foram encontrados registros de patentes com menção à atividade antimicrobiana de P. americana e S. malaccense. Desta maneira, estas plantas são passíveis de estudos nessa área para posterior depósito de patentes de produtos ou processos relacionados a elas.
