I JORNADAS DE DIREITO DO TRABALHO: DISCURSO DE

ENCERRAMENTO

Com as jornadas jurídicas do trabalho, percorremos, ao longo destes três dias, os caminhos da evolução do direito laborai em diversas partes do Mundo. No decurso desta viagem houve lugar a momentos de paragem para reflexão e troca de experiências, que muito aproveitarão aos objectivos que estiveram na base da organização destas sessões de trabalho — o aperfeiçoamento e estruturação do ordenamento jurídico de Macau.

E, se, no contexto desse ordenamento jurídico, o direito laborai representa, hoje, ainda uma pequena parcela, a sua inegável importância recomenda e exige que nos empenhemos na sua valorização e no aperfeiçoamento e reforço dos seus comandos. E, exige-o, na razão directa da nobreza do esforço que persegue — a realização da justiça social.

Tenho por isso, antes do mais, de agradecer a vossa prestimosa colaboração nesta tão delicada tarefa que em Macau se tem por imperiosa e urgente. Macau, após 1999, reger-se-á ao longo dos 50 anos seguintes pelo direito que entretanto for capaz de construir e cimentar.

E, a essa luz, a urgência de iniciativas como esta torna-se ainda mais candente, se pensarmos nas carências existentes e na escassez de tempo que nos resta para as suprir com dignidade.

Aliás, as conclusões, cuja leitura acabamos de ouvir, irão certamente servir de estímulo e mobilização para a realização de acções similares tendo em conta a necessidade de, neste como noutros domínios, andarmos depressa e bem.

As questões abordadas, como resulta das conclusões, não se restringiram ao contrato de trabalho, mas transbordaram para o social e para a própria política de trabalho, aumentando por isso o

interesse destas jornadas e sobretudo valorizando os seus resulta- dos, que permitirão, estou certo, nesta terra única, onde o Oriente e o Ocidente se encontram há mais de quatrocentos anos, a maior aproximação entre os especialistas votados às grandes questões sócio-laborais com que o Mundo se debate.

A terminar agradeço, por isso, o empenhamento de todos os participantes destas jornadas que pelo seu carácter aberto fez com que se tenha dado a desejável interpenetração entre os diversos temas, fossem eles do Oriente ou do Ocidente.

INTRODUCTION

1. It is not an overstatement to reaffirm the importance achieved by the Seminar on Legislation for Labour and Employment, carried out in Macau during the period of 5 and 7 of December of last year, in which several subjects of great acuity for the labour field were discussed, such as those of retribution, of labour relationship in the Region of Asia-Pacific, of individual work contract and of the duration of the working hours, subjects which thorough treatment is perfectly demonstrated by the Communications issued and which the promoters decided now to publish.

The increasing importance that, in worlwide levei, the subjects related with Labour and Employment are achieving derives from the progressive valorization which is being attributed to them in the ideological scope, as an expression of the human personality, an efficient cause of the command of man on nature and on the changes in the world, in the social-economical field, by its implication in the production and in the creation of assets in the political plan, and for the increasing importance that, in the major part of the countries the labourers are conquering assuming or not themselves as «working classes».

2. The prominence of these matters may, also, be evaluated by the increasing development that the labour laws are achieving, either for their contribution in the reduction of social strains, as it is envisaged for these laws to establish adequate rules to solve, or at least, to limit those conflicts, or as an instrument for the definition of working conditions or still, and finally, by force of its structure based on a fundamental teleological element: the protection of labour and of the labourer.

Reflecting — as it was pointed out by the Regional Counselor for the International Labour Organization for the Labour Relationship — Mr. Carmelo C. Noriel — a concern shared by OIT, having in mind the gradual betterment of the working conditions and of the living stahdards and the promotion of the principie of social justice, the Seminar on Labour Legislation and Employment has enabled a particular analysis of the tendencies and problems of the labour relationship in the Region of Asia-Pacific, having this realization

constituted an important step for the treatment of the subjects discussed and to bring closer countries, territories and economical áreas of the Region.

3. Therefore, it is considered as extremely successful the initiative of the Direction of Labour and Employment Services, for the excellent results achieved. Undertakings of this nature in such

important domains — as those of Labour and

Employment—present unquestionable advantages derived from the exchanging of distinctive experiences by those who share common problems and from which they can only retrieve benefíts, in where concerns, mainly, the profound scientifíc study of the subjects and the approximation of the legal solutions encountered.
