I – CONDIÇÕES GERAIS
ART. 1° - O “LEILÃO DA TOTALIDADE DA GERAÇÃO 2008 DO STUD TNT”, será
realizado no dia 29 de Abril de 2010, quinta-feira, às 20 horas, no Tattersall do Jockey Club Brasileiro, Rio de Janeiro.
ART. 2° - A arrematação far-se-á pelo maior lance.
ART. 3° - Os produtos a serem licitados estarão à disposição dos interessados, a partir de 20 de abril, terça-feira, no Hipódromo da Gávea, Vila Hípica, nos grupos de
cocheiras 24, 30 e 36, após as 8 horas da manhã.
ART. 4° - É facultado aos interessados fazer examinar por técnicos de sua confiança os
produtos a serem licitados, antes do Leilão. Portanto, são INACEITÁVEIS quaisquer reclamações posteriores. Os animais serão vendidosno estado em que se encontram no momento da arrematação, portanto não serão aceitas quaisquer reclamações ou possível cancelamento. Após a batida do martelo, a venda é definitiva e considerada como boa e perfeita.
ART. 5° - O vendedor e a APPS (Agência Paulista do Puro Sangue) não se responsabilizarão
por quaisquer alterações ocorridas no estado dos animais após a arrematação, tampouco acidente de transporte.
Parágrafo único – Lembramos aos interessados que procedam com antecedência a devida revisão dos animais, pois, uma vez na pista, a distância impede muitas vezes a verificação de detalhes, somente visíveis de perto, e reclamações desta natureza não serão aceitas.
ART. 6° - Os animais, após o leilão, retornarão aos locais de origem, e deverão ser
retirados no prazo de 3 (tres) dias a contar da data da arrematação.
ART. 7° - Os lances corresponderão ao valor da parcela mensal e seu valor será
determinado pelo leiloeiro.
ART. 8° - Foram dispensados os necessários cuidados para que o catálogo esteja correto,
mas a APPS (Agência Paulista do Puro Sangue), os vendedores e o leiloeiro não respondem por erros ou omissões do mesmo. Eventuais correções feitas durante o leilão prevalecerão sobre o catálogo.
II – DOS COMPRADORES
ART. 9° - Os compradores poderão optar pelas seguintes condições de pagamento:
- 15 parcelas mensais iguais e sucessivas, sem juros e sem correção. - à vista com desconto a ser anunciado pelo leiloeiro.
- Os animais arrematados por valor de parcela inferior ou igual a R$ 300,00 (Trezentos reais), deverão ser pagos à vista.
ART 10° - Os interessados em obter financiamento deverão apresentar, à APPS, cadastro
para apreciação, até 10 dias antes do leilão.
Parágrafo único - Os compradores que não estiverem cadastrados ou aqueles cujos cadastros não forem aprovados terão que efetuar o pagamento à vista, gozando do desconto estipulado.

ART. 12° - Aos compradores compete ainda:
a. assinar, nota promissória no valor correspondente ao preço da aquisição, mais as taxas devidas,com vencimento contra apresentação eque deverá ser paga ou substituída quando da regularização da compra.
b. Assinar, a transferência de propriedade; c. Assinar, o contrato de financiamento;
d. Os acertos das compras deverão ser efetuados junto à APPS, no local do leilão, ou em seu escritório localizado na Vila Hípica 4, Hipódromo da Gávea.
ART. 13° - O ICMS é de responsabilidade do vendedor na forma do decreto 34.448. Os
produtos com idade inferior a 36 meses estão isentos de ICMS. Entretanto, para vendas interestaduais, o imposto é devido e seu recolhimento será de responsabilidade do comprador.
III – DOS VENDEDORES
ART. 14° - Pagar as despesas do leilão que serão rateadas por animal, além da importância
de R$ 250,00 (duzentos e cinquenta reais) referente a inscrição compulsoria na “Copa Leilões”, instituida pelo Jockey Club Brasileiro.
ART. 15° - No caso da não apresentação do animal inscrito,seu responsável também
deverá pagar a importância mencionada acima.
ART. 16° - Apresentar o animal inscrito, no dia e local designados, devidamente
encabrestados, acompanhado de seu respectivo cavalariço, carteira de identidade e exame negativo de AIE, dentro do prazo de validade do mesmo, exigido pelo serviço de Veterinária do Jockey Club. Os animais deverão estar no Tattersall até as 19 horas do dia do leilão;
ART. 16° - No caso de defesa ou forfait, o vendedor terá 5 (cinco) dias úteis para efetuar
o pagamento, após este prazo,incidirão juros sobre o débito.
a. na defesa, o vendedor ficará responsável pelo pagamento das taxas de comprador, além das despesas previstas no art. 14°.
III – CONDIÇÕES FINAIS
ART. 17° - O animal arrematado será entregue pelo vendedor mediante autorização, por
escrito, da APPS (Agência Paulista do Puro Sangue), a qual será dada imediatamente após a regularização da compra, correspondendo ao vendedor a responsabilidade de manutenção do animal até, no máximo, 2 (dois) dias subsequentes à arrematação.
A partir do 3° (terceiro) dia, as despesas de manutenção ficarão por conta do comprador, pagas diretamente ao vendedor no dia da retirada do animal no valor de R$ 30,00 (trinta reais) a diária.
Parágrafo único - Eventuais problemas decorrentes da não retirada do animal são de exclusiva responsabilidade do comprador.
ART. 18° - A palavra do leiloeiro, no decorrer do Leilão, está credenciada a alterar ou
O leiloeiro reserva-se o direito de não aceitar lances de pessoas que, a seu exclusivo critério, julgar não responsáveis, sendo seu julgamento soberano.
ART. 19° - Fica estabelecido o fôro da cidade do Rio de Janeiro, RJ, para a eventualidade
de qualquer pendência judicial.
ART. 20° - No caso de acerto direto entre as partes, as taxas deverão ser pagas à
Agência. Após o prazo de 2 (dois) dias, se o comprador não tiver efetuado o pagamento, o débito será efetuado contra o vendedor.
ART. 21° - As taxas do leilão são irrestituíveis, mesmo para casos de anulação.
ART. 22° - Os casos omissos serão julgados pelo vendedor e pela APPS, a seu exclusivo
critério, sendo finais e definitivas as suas decisões, não podendo ser encaminhado nenhum tipo de reclamação, sem primeiro ocorrer o acerto inicial.
ART. 23° - É facultado ao vendedor a exigência de avalista. No caso da não aprovação do
mesmo, o comprador ficará sujeito ao pagamento à vista.
ART. 24° - O não pagamento de uma das notas promissórias implica no vencimento
automático de todas as demais, ainda por vencer.
ART. 25° - As vendas realizadas no leilaõ são irrevogáveis, não podendo o comprador
recusar o animal ou solicitar redução de preço (art. 1106 do Código Civil). Todos os participantes obrigam-se a acatar as disposições do regulamento, não podendo se excusarem de aceitá-las, alegando que não as conheciam (art. 3° da Lei de introdução Civil).
ART. 26° - A APPS não é responsável por eventuais problemas nas aquisições feitas
através do sistema telefônico implantado no leilão.
ART. 27° - Os compradores terão o direito de examinar os animais por veterinários e
treinadores, inclusive pedindo exames de endoscopia e radiografias por carta, não sendo aceitas devoluções posteriores à arrematação, conforme regulamento dos leilões.
ART. 28° - Os participantes deste leilão, especialmente inscritos e arrematadores,
obrigam-se a acatarem as disposições destas normas Específicas, instituídas pelos Jockey Club de São Paulo, Jockey Club Brasileiro, Jockey Club do Rio Grande do Sul e Jockey Club do Paraná.
ART. 29° - O Compromissário Comprador, depois de notificado por via postal, com prazo
de cinco dias, outorga desde já poderes especiais e irrevogáveis aos Jockeys Clubes Brasileiro, de São Paulo, do Paraná e do Rio Grande do Sul, a critério do vendedor, para debitar em conta corrente do proprietário e/ou criador, todas as parcelas devidas e referentes ao presente compromisso de compra vencidas e não pagas nas épocas convencionadas, inclusive juros de mora e/ ou multa contratual, dando como bons e corretos os débitos eventualmente feitos, sem direito a qualquer reclamação ou contestação. Os valores debitados em conta corrente do Compromissário Comprador serão levados a crédito em conta corrente do Promitente Vendedor, caso não haja contranotificação fundamentada. Para todos os fins de direito, o endereçamento da notificação postal será o constante no contrato firmado pelo Compromissário Comprador, cabendo a ele no caso de mudança comunicar, por escrito, ao Promitente Vendedor.
I - GENERAL CONDITIONS
ART. 1° - The auction of yearlings from Stud TNT, will take place on April 29 th 2010
thursday at 20:00, at Tattersall of Jockey Club Brasileiro.
ART. 2° - The winning bid will be the purchase price.
ART. 3° - Before the Auction, it is permitted for potential buyers to have technicians
or experts of their trust to inspect the products to be auctioned. Therefore, no poste-rior complaints will be accepted afterwards.
ART. 4° - The sales representatives and APPS (Agencia Paulista do Puro Sangue
Ltda) will not be responsible for whichever alterations that occured in the condition of the animals after the end of the bidding, or any accidents involving transportation.
Paragraph 1° - We remind potential buyers to previously effect the check up the
animals, for, once they are in the ring, the distance very often makes it impossible to verify details that are only visible when closely inspected, and, no such complaints will be accepted.
ART. 5° - After the auction, the animal will be returned to their original barns, and,
should be retrieved within a maximum deadline of two days after the auctions.
ART. 6° - The biddings will correspond to the amount of the monthly installment and
this value will be determined by the auctioneer.
ART. 7° - All the necessary attention was given in order for this catalogue to be
faultless but, the APPS - Agencia Paulista dp Puro Sangue Ltda - the sales representatives and auctioneer, are not liable for possible mistakes or omissions in this catalogue. Eventual corrections done during the auction will prevail over the catalogue.
II - BUYERS
ART. 8° - The Buyers may opt for the following payment forms:
- 15 installments without interest rate or monetary correction. - Cash payment with a discount of 10% (ten percent).
- It is allowed for buyers who choose to seek from the seller financing to settle their debts at any moment, applying the discount established by the sale representative.
ART. 9° - Those interested in obtaining financing should forward a credit profile to
APPS within 10 days before te auction.
Paragraph 1° - The buyers that do not have a credit profile registered, or, those
whose credit profiles are not approved will have to pay in cash, but, still applying the established discount.
ART. 10° - The buyers will have to pay the following commission and fees.
a) 8% (eight percent) on the final bidding price, and this is applied on any payment
option.
b) Transference of ownership.
ART. 11° - The buyers will also have to:
a) Sign in the act of the purchase a promissory note with a value corresponding to the
price of the acquisition plus the due commissions, with a maturity date against the payment and that should be paid or substituted upon the regularization of the purchase.
b) Sign after final bidding the transference of ownership. c) Sign after final bidding a finance contract.
d) Al the necessary purchase adjustments should be done in APPS’s the office set up
in the location of the auction after the final bidding.
ART. 12° - The ICM (ADDED VALUE) is a responsibility of, the sellers in accordance
to the decree 34.448. The animals with ages bellow 36 months are exempted from the ICM, nevertheless, for interstate sales, the tax is due to be paid and is of the responsibility of the buyers.
III - SELLERS CONDITIONS
It is up to the sellers:
ART. 13° - To pay for the auction expenses.
ART. 14° - In the case of withdrawal of enrolled animals, the responsible seller will
have to pay for the auction expenses.
ART. 15° - Display the enrolled animal on the date and place scheduled, duly haltered
accompanied by his groom, identification card, and a negative exam from AIE, within the validity term of the same institute, required by the veterinarian service of the Jockey Club. The animals must be present at the Tattersall until 19:00 of the auction date.
IV - FINAL CONDITIONS
ART. 16° - The purchased animal will be delivered by the seller, using a written
authorization from APPS (Agencia Paulista do Puro Sangue Ltda), which will be supplied immediately after the settlement of the purchase being the responsibility of the seller for the upkeeping of the animal for at most 2 (two) subsequent days after the auction.
After the 3° (third) day, all the upkeeping expenses will be the responsibility of the purchaser, and paid directly to the seller, or the day of the retrieval of the animal with a value of R$40,00 (forty reais) per day.
Paragraph - Eventual problems occurring from the failure of retrieving the animal,
people who, according to his understanding, may not have the required conditions, and, his judgment is not liable to be appealed.
ART. 18° - It is established herein the court in Rio deJaneiro - RJ, to settle any
eventual juridical problem.
ART. 19° - After the 2 (two) workday term, in case a settlement has not been reached
by the buyer, the seller may or may not accept with the agreement of teh organizing agency a substitution of the buyer.
ART. 20° - In case of a direct settlement between the parties, the comission will have
to be paid to the agency.
ART. 21° - The auction comitions are not refundable, even in the case of an annulment. ART. 22° - Any doubts will be judged by the sellers ans APPS applying there own
exclusive criteria, being final and definitive in their decisions, not being allowed to be forwarded any kind of complaint without first occurring an initial settlement.
ART. 23° - The seller has the right to demand a cosigner. In case of the cosigner
failing to be approved, the buyer will be subjected to a payment in cash.
ART. 24° - The failure to pay one of the promissory notes will lead to all the remaining
ones having their due dates anticipated for the present date.
ART. 25° - After a term of 7 (seven) weekdays, in case a settlement is not effected by
the buyers, the seller may cancel the sale.
ART. 26° - The committed buyers, after having been notified via mail within 5 (five)
days give special and irrevocable powers to the Jockey Club to charge in their current accounts all the installments owed referring to the present committement of purchase due unpaid in specific dates, including interest rates and/or contractual fines which will compensate any eventual debt involved in the negotiation, the buyer does not have any added rights to appeal on contest the measure talken.
ART. 27° - APPS is not responsible for any eventual problem in the acquisition done
