Compliance and enforcement of legislation by ANVISA is a policy tool for political agenda.

As an example, ANVISA’ directors Jose Agenor stated, during public board meetings on June,14.2012, - referring to the fact that ANVISA does not comply nor enforce different laws -, made the following statement: “it is okay that ANVISA looses in court, but politically
it is important to make those decisions”.

Several lawsuits against ANVISA are filed by local companies. They seek to maintain
favorable interpretation of laws established in the past by ANVISA, that have lowered the standards to obtain marketing approval by abbreviated means.

ANVISA’s regulations in the last few years decrease the standard required by companies seeking to obtain marketing approvals by abbreviated means.
