His Britannic Majcfly, and His Royal Highnefs the Prince Regent of Portugal, do ilipulate and agree that there lhall be a peried Reciprocity on the Subjed of the Duties and Impofts to be paid by the Ships and Veflels of the High Contrading Parties within the fevcral Ports, Harboursj Roads, and anchoring Places belonging to each of them ; to wit, that the Ships ami Veflels of the Subjeds of His Britannic Majefty lhall not pay any higher Duties or Impolls (under whatfoever Name they be deiig- nated or implied) within the Dominions of His Royal Highnefs the Prince Regent of Portugal, than the Ships and Veflels belonging to the Subjeds o f His Royal Highnefs the Prince Regent of Portugal lhall be bound to pay within the Dominions of His Britannic Majcfly, and vice verla. And this Agreement and Stipulation lhall particularly and exprefsly extend to the Payment of the Duties known by the Name of Port Charges, Tonnage, and Anchorage Duties, which lliall not in any Cafe, or under any Pretext, be greater for Britifh Ships and Veflels within the Dominions of Ills R o)al Highnefs the Prince Regent of Portugal, than for Portuguefe Ships ai d Veflels within the Dominions of His Britannic Majefty, and vie® ■versa.

The Two High Contrading Parties do alfo agree, that the fame Rates of Bounties and Drawbacks lhall be eftablilhed in their refpedive Ports upon the Exportation of Goods and Merchandizes, whether thofe Goods or Merchandizes be exported inBritifli or in Portugueze Ships and Veflels, that is, that Britifli Ships and VelTels lhall enjoy the lame Favour in this Refped within the Dominions of His Royal Highnefs the Prince^ Regent of Portugal, that may be ihewn to Portugueze Ships and VeflTels within the Dominions of Plis Britannic Majefty, and vice veriâ. It is agreed and covenanted, that Perfons guilty of High Treafon, Forgery, or other Offences of a heinous Nature, within the Dominions of either of jh e High Contracting Parties, fhall not be harboured nor re- . ceive Protedion in the Dominions of the other. And that neither of the High Coiitrading Parties fliall knowingly and wilfully receive into and entertain in their Service Perfons, Subjects of the other Power, deferring from the Military Service thereof, whether by Sea or Land ; but that on the^ contrary they ilrall each refpedively difeharge any fuch Perlbn from their Service, upon being required; But it is agreed and declared, that neither of the High Contracting Parties fliall grant to any other State any Favour on the Subject of Perfons deferting from the Service of that State, which fliall not be coniidered as granted alio to the other High Contrading Paity, in the fame Manner as if the faid Favour had been exprefsly fli- pulated by the prefent Treaty. And in cafe that any Sufpicion of Fraud or unfair Praflices ihould arife, the Invoices iliall be examined, and the real Value of the Goods or Merchandizes afeertained by a Reference to an equal Number of Britifli and Portugueze Merchants of known Integrity and Honour; and in cafe of a Difterence of Opinion amongil them, folloived by an Equality of Votes upon the Subjedt, they ihall then nominate another Merchant, likewife of known Integrity and Honour, to whom the Matter iliall be ultimately re- ferxed, and whofe Decifion thereon ihall be final, and without appeal. And in cafe the Invoice iliould appear to have been fair and corredl, the Goods and Merchandizes fpecified in it, iliall be admitted on paying the Duties abovementioned of Inffeen p r Cent, and the Expences, if any, of the Examination of the Invoice, iliall be defrayed by the Party wEo called its Fairnefs and Correctnefs into queition. But if the Invoice iliall be found to be fraudulent and unfair, then the Goods and Merchandizes iliall be bought up by the Officers of the Cuiloms on the Account of the Portu gueze Government, according to the Value fpecified in the Invoice, with an Addition of Ten per Cent, to the Sum fo paid for them by the Officers of the Cuiloms, the Portugueze Government engaging for the Payment of the Goods fo valued and purchafed by the Officers of theCufio ns within the Space of Fifteen Days, and the Expences, if any, of the Exaniinadon of the fraudulent Invoice iliall be paid by the Party who prefented it as juft and fair.

It is agreed and covenanted, that Articles of Military and Naval Stores brought into the Ports of His Royal Highnefs the Prince Regent of Portu gal, w’hich the Portugueze Governmeni may bedefirous of taking for its own IJie, iliall be paid for without Delay at the Prices appointed by the Proprietors, who ihall not be compelltd to fell fuch Articles on any other Terms.
And it is further ftipulated, that if the Portugueze Government ihall take into its own Care and Cuftody any Cargo, or Part of a Cargo, with a View to purciiaie, or otherwife, the laid Portugueze Government fliall be refponfiblfc for any Damage or Injury that fuch Cargo, or Part of a Cargo, may receive while in the Care and Cuftody of the Officers of the Laid Portugueze Government.

Mas fe fe achar que a Faclura foi fraudulenta, e illicita, então cs Generös, e Mercadorias ferao comprados pelos Olficiaes da blfandega por Conta do Governo Portuguez, fegundo o valor efpecifi- cado na Faftura, com huma addiçao de Dez por Cento fobre a Somma aíTim paga pelos refferidos Generös e Mercadorias pelos Officiaes da Alfân dega, obrigande-fe o Governo Portuguez ao pagamento dos Generös aíliin avaliados, e comprados pelos Officiaes da Alfandega, dentro do efpaço de Quinze dias. E as Defpezas, fe as houver, do exâme da fraudulenta Fac-* tura lerão pagas pela Parte que a tiver aprefentado como jufta, efiel.
ARTIGO XVII.
Conveio-fe e ajuílou-fe, que os Artigos de Trem MÍTitar e Naval im portados nos Portos de Sua Alteza Real O Principe Regente de Portugal, e que o Governo Portuguez haja de querer para feu Ufo, ferão pagos logo pelos preços eftipulados pelos Proprietários, que não ferào conítrangidos a vendelos debaixo de outras Condições.
Demais eflipulou-fe, que fe o Governo Portuguez tomai* a feu proprio cuidado, e guarda alguma Carregação, ou parte de huma Carregação, com viílas de a comprar, ou para outro qualquer fim, o dito Governo Portu guez ferá refponfavel por qualquer perda, e damnificaçao que ella pofla foffrer em quanto eíliver entregue ao cuidado e guarda dos Officiaes do ref- ferido Governo Portuguez.
