The XIII Pan American Sanitary Conference adopted Resolution XII as follows:

"WHEREAS

"Article 105 of the Charter of the Organization of American States, signed April 30, 1948, at the Ninth International Confer-ence of American States, provides that '...the juridical status of the Inter-American Specialized Organizations and the privileges and immunities that should be granted to them and to.their'person-nel... shall be determined in each case through agreements between the respective Organizations and the Governments concerned'; and

'"The Pan American Sanitary Bureau is desirous of determining the privileges, exemptions, and immunities to be granted to it by

Member Governments;

"THE XIII PAN AMERICAN SANITARY CONFERENCE

"RESOLVES:

"1. To authori.ze.the Director of the Pan American Sanitary Bureau to conduct appropriate negotiations with Miember Governments with a view to arriving at satisfactory formal arrangements regard-ing the privileges, exemptions, and immunities which.shall be

enjoyed by the Pan-American Sanitary Bureau as an official inter-national agency.

"2. To recommend that Member Governments, through their appropriate constitutional and legislative procedures, enter into an agreement with the Pan American Sanitary Bureau on the subject of privileges and immunities."

Report

The Director of the Bureau herewith presents this report to the Directing Council on the action taken under the above resolution and the current status of the matter.

1. A short-form model bilateral PASB Agreement on Privileges and Immunities was developed by the Bureau, adapted from the respective Con-ventions on the subject of the United Nations and the Organization of American States, and the Host Agreement of the World Health Organization. This model Agreement covers the basic privileges and immunities required for the normal operations of the Bureau as an official international organization.

2. To date, the Bureau has concluded bilateral Privileges and Immu-nities Agreements with the following Member Govwrnments:

Argentina (Host Agreement) Brazil (Host Agreement) Costa Rica

Guatemala (Host Agreement) Nicaragua

Panama

3. Active negotiations with the Government of Mexico are presently under way in connection with the establishment of the PASB Zone Office in that country.

4. A similar Agreement with regard to the Lima Zone Office has been submitted to the Government of Peru which presently has the matter under study.

5. The Bureau's Zone Representatives have circulated copies of the model Agreement to the Member Governments in their region and it is expected that these Agreements will be formally concluded in due course.

6. The international status of the Bureau in the United States is defined by domestic legislation and a special Executive Order accords the privileges and immunities which satisfactorily meet the needs of the Headquarters, Office.

7. The Director of the Bureau will provide the Directing Council
