Topic .17. AMENDIENTS TO THE RULES OF PROCEDURE OF THE DIRECTING COUNCIL

Background

The Executive Committee, at its 17th Meeting (Havana, September 1952), had before it the Report of the Permanent Com-mittee of the Executive ComCom-mittee on Amendments to the Rules of Procedure of the Directing Council wherein certain draft amend-ments to the Rules of Procedure were proposed for consideration. The afore-mentioned Report and proposed amendments were consid-ered by the Executive Committee and the following Resolution was adopted by that body (Resolution V, approved 11 September 1952):

"WHEREAS:

The report of the Permanent Committee of the .Executive Committee on Revision of the Rules of

Pro-cedure of the Directing Council (Document CE17/13) notes that amendments to the said rules are neces-sarily dependent upon changes that may be intro-duced in the Constitution of the Pan American Sani-tary Organization, and that the said Permanent Com-mittee has decided to postpone the presentation of a set of definitive Draft Rules of Procedure until the Proposed Constitution has been finally adopted by the Organization;

"The aforesaid Permanent Committee recommends that, as a temporary measure, Resolution XV, adopted at the V Meeting of the Directing Council, be imple-mented by appropriate amendments to the present Rules of Procedure of the Directing Council; and

"The Executive Committee concurs in the point of view of the said Permanent Committee in this

;'THE EXECUTIVE COMMITTEE,

RESOLVES:

;'To recommend to the Directing Council the adoption of the following amendments to the Rules of Procedure of that body, on a provisional basis:

'.Article 6 /Sew7- If a representative of territories is elected an officer at any meeting, the said representative shall not officiate during a session at which any of the matters enumerated in Article 7A is under discussion.

"Article 7A /New7- All meetings of the Di-recting Council shall at the same time be'meetings of the Regional Committee of the'World Health Organ-ization except when the Directing Council is consid-ering constitutional matters, the juridical relations between the Pan American Sanitary Organization and the World'Health Organization or the Organization of American States, or other questions relating to the Pan American Sanitary Organization as an Inter-American Specialized Organization.

"Article 10 tAmended7- Decisions shall be taken by the affirmative votes of the majority of representatives of Members and, in cases where they are entitled to vote, the territories, present and voting. For the purpo'se of these Rules, the phrase

"'present and voting" means representatives of Members and territories who cast an -affirmative or negative vote. Representatives who abstain from voting are considered not Voting.

"Article 11 LZmendel-/- Representatives of ter-ritories are entitled to participate and-vote on the

same basis as those of Members, except that they

shall not participate or vote when any of the matters -enumerated in -Article 7A are under discussion.

~ "Article 11A 9 ew7- The' privilege of voting in the plenary sessions on Pan American Sanitary Organ-ization budget matters' may be exercised by the rep-esentatives of territories, but this privilege shall be contingent on an equitable contribution to the ,budget of the Pan American Sanitary Orgaanization

"IArticle lB LZeJ7- Representatives of ter-ritories under.the jurisdiction of the same non-American State shall vote as a single unit in the plenary sessions and.in the committees whenever they are entitled to vote. Only one vote may be

cast on behalf of each such unit.

'PArticle-. 28 [Amended7- Representatives of territories shall.be entitled to participate, with :. ':the right to vote-, in the committees of the

Di-recting Council, except that they shall not have the right.to vote-when matters enumerated in Article 7A are under discussion."

"Recognizing that amendments to the Rules of Procedure of the. Directing Council-are necessarily dependent upon the changes that may be introduced in the Constitution of the Pan American

Sanitary Organization, the ZPermanent/ Committee has decided to psetpone the presentation-of a set of.definitive. Draft Rules of

Procedure until the Proposed Constitution has been finally adopted by the Organization...

... However, the Permanent Committee deemed it advisable to consider modifications in the Rules of Procedure in order to bring these into accord.with resolutions already adopted by the Directing

Council. Consequently, it .was decided, as a temporary measure, to give effect to Resolution XV, adopted at the V Meeting of the Di-recting Council, the operative part of which reads as follows:

'1. That all meetings' of the'Directing Council shall at the same time be meetings of the Regional Committee of the World Health Organization except when-the Directing Council is considering constitutional mat-,ters, the juridical relations between the Pan American

Sanitary Organization and the 'world Health Organiza--· -a tion or the Organization of. American States,-or'other

questions relating to.the Pan American Sanitary Organ-ization as an Inter-American Specialized OrganOrgan-ization.

'2. That, .modifying paragraphs (a) and.(b).of Resolutior'II of the II Meeting of the Directing. Council, the vote on Pan American Sanitary Organization budget matters ih granted to States Members of the World Health Organ-. ization not having their seats of.;government within the

Western Hemisphere, which '"(a) either by reason of their Constitution consider certain territories or groups of territories in the Western Hemisphere as part of their national territory, or (b) are responsible for the conduct of the international relations of territories or groups of territories within the Western Hemisphere". The vote thus granted shall be on behalf of these territories and shall be contingent upon their making an equi-table contribution to the budget of the Pan American Sanitary Organization. The privileges of voting on the Pan American Sanitary Organization budget thus granted may be exercised either by the representa-tive of such territories or by the representarepresenta-tives of the Member States of the World Health Organiza-tion referred to above.

'3.- To amend the Rules of Procedure of the Directing Council, in accordance with the recommendation of the Executive Committee, to provide inter-alia that if the representative of a non-member State of the Pan American Sanitary Organization is elected an officer at any meeting, such representative will not officiate in the sessions at which any of the

matters mentioned in paragraph 1 is under discussion.'

If the Directing Council concurs in the recommendation of the Executive Committee as formulated in the above-cited Resolu-tion (Document CE17/35), the following ResoluResolu-tion is proposed:
