PROTOCOL FOR HOSTING INTERNSHIPS IN THE Ministry of Foreign Affairs of the Portuguese Republic

Between

The Portuguese State, through the Ministry of Foreign Affairs of the Portuguese Republic, at Palácio das Necessidades, Largo do Rilvas, 1399-030 Lisboa, represented herein by Ambassador Ana Maria da Silva Marques Martinho, Secretary General of the Ministry of Foreign Affairs of the Portuguese Republic, hereinafter referred to as MNE;

The Faculty ………. of the University …………. at ………….., …….., legal person Reference No. …………., represented herein by its ……….., Mr./Mrs ……….., hereinafter referred to as [UNIVERSITY/FACULTY];

The Student [full name], No. …………., holder of the identity card bearing No ……….., living at ………… and studying …………. [undergraduate/graduate degree] at the [University], hereinafter referred to as Student.

Shall be concluded in good faith, on the following terms and conditions laid down and mutually accepted by the parties:

1 Purpose

Under the present Collaboration Protocol, hereinafter referred to as Protocol, MNE shall undertake to provide the Student [IDENTIFICATION/COURSE TITLE], chosen by the [UNIVERSITY/FACULTY], with a curriculum-based internship aiming to complement his/her academic background in [FIELD OF STUDY], in the [NAME OF MNE’S UNIT/ADDRESS], with the approval of its director, and according to the internship plan agreed upon by all parties to the present Protocol.

Legally binding relationship

1. The internship undertaken under the present Protocol is an unpaid curriculum-based internship and does not give rise to any legally binding relationship between the Student and MNE. Its commencement and duration do not create any kind of relationship under public or private law, such as employment, appointment, secondment, procurement or service delivery.

2. The Student expressly acknowledges and agrees on the one hand that he/she is not, nor shall he/she ever be regarded as agent, service provider, official or staff member of the Portuguese State and, on the other, that MNE shall not be regarded as his/her employer. Thus he/she has none of the rights arising out of a legally binding employment relationship be it under public or private law.

Lack of remuneration

Undertaking the internship shall not entitle the Student to claim remuneration, allowances, contribution to expenses or any other type of monetary compensation, including travel expenses to and from the place of the internship, from MNE.

1. The purpose of the present Protocol is to offer a curriculum-based internship which shall take place at [location/unit], from ……… to ……….. 2015, starting on [date] and running until [date] included.

2. The curriculum-based internship requires a commitment of at least ……… working hours within the normal office hours of MNE’s unit in which the intern will be working.

Duties of the [UNIVERSITY/FACULTY]

1. The [UNIVERSITY/FACULTY], through the co-ordination of the courses ……….., shall undertake to:

a) Explain the conditions governing the internship in MNE to the students; b) (….)

Student’s insurance

The [UNIVERSITY/FACULTY] shall undertake to provide the Student with a valid insurance cover against the risks he/she may face throughout the internship, and to that effect it shall inform the insurance company concerned of the location where the internship will take place and produce evidence of its validity on the Protocol’s date of signature. The documentary evidence shall form part of this Protocol as Annex I.

7 MNE’s duties MNE, through the [name], shall undertake to:

a) Appoint an internship supervisor to guide and help the student studying at [UNIVERSITY/FACULTY];

b) Host the Student studying at [UNIVERSITY/FACULTY] during the agreed internship period;

c) Explain to the Student the work to be done during his/her internship, as well as give him/her information about the internship schedule and location;

d) Ensure, so far as possible, that the Student may undertake his/her internship within his/her academic field by dealing with matters and performing tasks related to

the subject fields within the undergraduate/graduate [……….] degree with a view to gaining a practical and real insight into the working world.

Student’s duties 1. The Student shall undertake to:

a) Abide by the organizational, technical and regulatory standards, as well as by the rules governing the functioning of MNE, in particular those concerning the office hours, the proper use of facilities, equipment and materials entrusted to him/her.

b) Observe strict secrecy with respect to any facts and information relating to MNE or to third parties connected to it, which come to his/her knowledge by virtue of his/her internship, and shall not directly or indirectly reveal them by any means whatsoever. c) Provide the Diplomatic Institute of the Ministry of Foreign Affairs of the Portuguese Republic (IDI) with a copy of all papers arising, whether directly or indirectly, from his/her internship in MNE.

2. In the event of non-compliance with those rules or of improper conduct, MNE may immediately suspend the student by informing the [UNIVERSITY/FACULTY] and, if the measure is found to be justified, it may terminate the internship.

3. A breach of the duty of secrecy under the present clause may constitute a criminal offence and give rise to civil liability, as broadly defined.

Internship plan

1. The curriculum-based internship must be undertaken within the framework of an internship plan, drawn up by the internship supervisor, appointed by MNE and accepted by the [UNIVERSITY/FACULTY], in collaboration with a mentor and the Student, and shall form part of the present Protocol as Annex II.

2. The teacher shall be responsible for ascertaining that the internship plan matches the course’s pedagogic goals.

3. The three parties mutually undertake to collaborate in good faith to carry it out. 10

1. In MNE the Student shall be supervised by an internship supervisor, [name or position] and, in the [UNIVERSITY/FACULTY] by a mentor.

2. Upon completion of the internship, the Student shall submit an informed critical report on the activity carried out within the internship framework to the [UNIVERSITY/FACULTY].

Student’s evaluation

MNE’s internship supervisor shall draw up a brief evaluation report on the Student at the end of the internship in this host entity, which the latter will have to submit together with the final report.

Information exchange

MNE and the [UNIVERSITY/FACULTY] shall undertake to mutually exchange information deemed necessary for the good running of the curriculum-based internships, as well as to keep in contact during the internships.

Suspension and early termination

MNE reserves the right to suspend or terminate the curriculum-based internship on grounds of breach of the duties owed by the student towards MNE or where justified on grounds of protection of State interests, without the [UNIVERSITY/FACULTY] or the Student being entitled to any claim or compensation.

14 Duration

The Protocol shall enter into force on the day of its signature and shall cease to be effective at the end of the internship, on ……. ………. 2014.

Cláusula 1.ª Objeto

Pelo presente Protocolo de Colaboração, adiante designado abreviadamente por Protocolo, o MNE compromete-se a facultar ao Aluno [IDENTIFICAÇÃO/CURSO] designado pelo [UNIVERSIDADE/FACULDADE] um estágio c urricular que tenha como objetivo complementar a formação académica do mesmo no domínio da sua área de estudos, no [NOME DO SERVIÇO MNE/MORADA], com a devida anuê ncia do respetivo dirigente, e que se revele adequado ao plano de estágio definido por acordo entre todas as partes do presente Protocolo.

Cláusula 2.ª Vínculo jurídico

1. O estágio objeto do presente Protocolo é de natureza curricular, não remunerado, e não determina o surgimento de qualquer relação jurídica entre o Aluno e o MNE, não se estabelecendo com o seu início e subsistência qualquer vínculo público ou privado, seja laboral, seja de nomeação, em comissão de serviço ou seja ainda de aquisição ou prestação de serviços.

2. O Aluno expressamente reconhece e aceita que não é nem será considerado para qualquer efeito, como agente, prestador de serviços ou trabalhador do Estado Português e que o MNE não será tido como sua entidade patronal, pelo que não lhe assistem quaisquer direitos decorrentes de uma relação jurídica de emprego público ou privado.

Cláusula 3.ª

Inexistência de remuneraç ão

A frequência do estágio não confere ao Aluno o direito de exigir do MNE uma remuneração, subsídio, comparticipação de despesas ou outro tipo de compensação pecuniária, incluindo as despesas de viagem, de e para o local de realização do estágio.

Cláusula 4.ª

Local, duração e período de estágio

1. O estágio objeto do presente Protocolo é de natureza curricular e decorrerá em (local/serviço) ____________ , nos meses de ... a ... de 20... , com início em……. e termo em ……….

2. O estágio curricular terá a duração total mínima total de ____ horas, devendo decorrer no horário normal do Serviço do MNE em que se insere.

Cláusula 5.ª

Obrigações d a [UNIVERSIDADE/FACULDADE];

1. A [UNIVERSIDADE/FACULDADE], através da Coordenação dos Cursos de ……. compromete-se a:

a) Esclarecer os alunos sabre as condições de estágio no MNE; b) (…)

Cláusula 6.ª Seguro do Aluno

A [UNIVERSIDADE/FACULDADE] compromete-se a realizar e assegurar um Seguro válido que cubra os riscos a que o Aluno possa estar sujeito durante o período de estágio, devendo para o efeito informar a respetiva seguradora do local onde o estágio vai decorrer e apresentar o comprovativo de validade do mesmo na presente data o qual passa a integrar este Protocolo como Anexo I.

Cláusula 7. ª Obrigações do MNE 0 MNE, através do Serviço de [inserir], compromete-se a:

a) Nomear um responsável de estágios que oriente e acompanhe o Aluno dos Cursos da [UNIVERSIDADE/FACULDADE];

b) Acolher o Aluno do Curso da [UNIVERSIDADE/FACULDADE];durante o período acordado para realização do estágio;

c) Esclarecer o Aluno sobre o(s) trabalho(s) a realizar ao Iongo do seu estágio, bem como sobre o horário e o local de estágio;

d) Assegurar, na medida do possível, q u e o Aluno possa realizar o seu estágio dentro do âmbito da sua experiência académica, ocupando-se de assuntos e de tarefas ligados às áreas de Licenciatura/Mestrado em [……...] com o objectivo de conhecer a realidade do trabalho de um ponto de vista prático e concreto.

Obrigações do Aluno

1. O Aluno compromete-se a:

a) Cumprir pontualmente as normas organizativas, técnicas e regulamentares bem como das regras de funcionamento do MNE, nomeadamente as relativas aos períodos de funcionamento, a boa utilização das instalações, equipamento e materiais que lhe sejam confiados.

b) Manter sigilo rigoroso e a não divulgar por qualquer meio quaisquer factos ou informações que tenha tido conhecimento, de forma direta ou indireta, no âmbito ou por causa do estágio e que digam respeito ao MNE ou a terceiros que com este se relacionem.

c) Entregar ao IDI uma cópia de todos os trabalhos que decorreram, directa ou indirectamente, do seu estágio no MNE.

2. Em caso de incumprimento daquelas regras ou de qualquer comportamento incorreto, o MNE pode suspender de imediato o Aluno, comunicando esse facto a [UNIVERSIDADE/FACULDADE], e se assim o entender justificado, dar por findo o estágio.

3. O incumprimento do dever de sigilo previsto na presente cláusula poderá constituir uma infração penal e dar Iugar a responsabilidade civil nos termos gerais.

Cláusula 9.ª Plano de Estágio

1. O estágio curricular é obrigatoriamente enquadrado por um plano de estágio que é definido, em colaboração pelo responsável indicado pelo MNE e aceite pela [UNIVERSIDADE/FACULDADE], por um orientador e pelo Aluno(a), e consta do Anexo II ao presente Protocolo dele fazendo parte integrante.

2. Cabe ao docente a validação da correspondência do plano de estágio aos objetivos pedagógicos do curso.

3. As três partes outorgantes obrigam-se reciprocamente a colaborar de boa fé na plena execução do mesmo.

Cláusula 10.ª Relatório Final

1. O Aluno será supervisionado no MNE por um responsável de estágio, [nome ou cargo] e, na [UNIVERSIDADE/FACULDADE], por um orientador.

2. No final do estágio, o Aluno deverá apresentar à [UNIVERSIDADE/FACULDADE] um relatório que compreenderá uma reflexão crítica e informada da atividade realizada no seu âmbito.

Clausula 11.ª Avaliação do Aluno

Após o final do estágio no MNE, o responsável de estágios desta entidade acolhedora elaborará uma breve avaliação do Aluno a ser entregue por este juntamente com o Relatório Final.

Cláusula 12.ª Troca de informações

0 MNE e a [UNIVERSIDADE/FACULDADE] comprometem-se, reciprocamente, a trocar informações consideradas necessárias ao bom funcionamento dos estágios curriculares e a manter contacto ao Iongo do período dos estágios.

Cláusula 13.ª Suspensão e cessação

Em caso de incumprimento das obrigações do Aluno para com o MNE ou quando a defesa dos interesses do Estado assim o justifique, o MNE reserva-se o direito de suspender ou extinguir o estágio curricular, sem que desse facto decorra para a [UNIVERSIDADE/FACULDADE] ou para o Aluno o direito a qualquer reclamação ou indemnização.
